The Ruling on a Woman Travelling to Hajj or Umrah Without a Mahram – Shaikh Muhammad bin Hizaam and Shaikh Ibn ul-‘Uthaymeen

Shaikh Muhammad bin Hizaam (may Allah preserve him) wrote:

“A group of the People of Knowledge took the opinion that a Mahram is a condition for the obligation of making Hajj and this enters into the expenses which Allah mentions: “those who can afford the expenses” [3:97]. It is the opinion of Ahmad, Ishaaq, ath-Thawri, ash-Shafi’ee in one statement, Ibn al-Mundhir, the Companions of Opinion, and from the Tabi’een: al-Hasan, an-Nakha’ee.

They used as evidence the Hadith in this chapter: on the authority of Ibn ‘Abbas (may Allah be pleased with him) who said: that I heard the Messenger of Allah (ﷺ) deliver a sermon saying:

لَا يَخْلُوَنَّ رَجُلٌ بِاِمْرَأَةٍ إِلَّا وَمَعَهَا ذُو مَحْرَمٍ, وَلَا تُسَافِرُ اَلْمَرْأَةُ إِلَّا مَعَ ذِي مَحْرَمٍ ” فَقَامَ رَجُلٌ, فَقَالَ: يَا رَسُولَ اَللَّهِ, إِنَّ اِمْرَأَتِي خَرَجَتْ حَاجَّةً, وَإِنِّي اِكْتُتِبْتُ فِي غَزْوَةِ كَذَا وَكَذَا, قَالَ: ” اِنْطَلِقْ, فَحُجَّ مَعَ اِمْرَأَتِكَ

“A man must never be alone with a woman unless there is a Mahram with her. A woman also may not travel with anyone except with a Mahram (relative).” A man stood up and asked, ‘O Messenger of Allah! My wife has gone for Hajj while I am enlisted for such and such a battle, what should I do?’ The Messenger of Allah (ﷺ) replied, “Go and join your wife in Hajj” [Muslim]

And the Hadith of Abu Hurairah and Ibn Umar (may Allah be pleased with them) in the Two Saheehayn:

وَلَا تُسَافِرُ اَلْمَرْأَةُ إِلَّا مَعَ ذِي مَحْرَمٍ

A woman also may not travel with anyone except with a Mahram

And it comes in other than the Two Saheehs.

It has come from Ahmad in a narration that a Mahram is a condition for the necessity of Sa’iy and not for the obligation for Hajj. And it comes in another narration that the Mahram is not a condition for the obligation of Hajj.

Ibn Sireen, Malik, ash-Shafi’ee, and al-Awzaai took the view that a Mahram is not a condition in any situation.

Ibn Sireen (may Allah have mercy upon him) said: ‘She can go out with a man from the Muslims’. Malik said: ‘She can go out with a group of women’. ash-Shafi’ee said: ‘She can go out with a free, Muslimah, who is reliable’. al-Awzaai said: ‘She can go out with a trustworthy group’.

They used as evidence that the Prophet (ﷺ) explained ability to mean provisions and a ride. They also used the Hadith of ‘Adi bin Haatim (may Allah be pleased with him) in Saheeh al-Bukhari (no. 3595):

فَإِنْ طَالَتْ بِكَ حَيَاةٌ لَتَرَيَنَّ الظَّعِينَةَ تَرْتَحِلُ مِنَ الْحِيرَةِ، حَتَّى تَطُوفَ بِالْكَعْبَةِ، لاَ تَخَافُ أَحَدًا إِلاَّ اللَّهَ

If you should live for a long time, you will certainly see that a lady in a Howdah traveling from Al-Hira will (safely reach Mecca and) perform the Tawaf of the Ka`ba, fearing none but Allah’

They said: ‘It is an obligatory trip and the Prophet (ﷺ) did not stipulate a Mahram for it, like a Muslimah if she escapes from the hands of the disbelievers’. This is the statement of Ibn Hazm.

Abu Abdillah [the author] (may Allah grant him Tawfeeq) says: the first opinion is the correct one due to the evidence that preceded. Ibn ul-Mundhir said: ‘They (those who said otherwise) have left off the opinion which is based on the apparent Hadith and each of them (i.e. these Scholars) stipulated a condition which has no proof for it’.

[The first opinion] is the chosen opinion of the Permanent Committee, Shaikh Bin Baz (may Allah have mercy upon him), likewise Shaikh Ibn ul-‘Uthaymeen, and Shaikh Muqbil al-Wadi’ee (may Allah have mercy upon them).

Abu Saeed رضي الله عنه reported that Jibreel عليه السلام came to Allaah’s Messenger ﷺ and said: Muhammad, have you fallen ill? Thereupon he ﷺ said: “Yes”. He Jibreel said:

بِاسْمِ اللهِ أَرْقِيكَ، مِنْ كُلِّ شَيْءٍ يُؤْذِيكَ، مِنْ شَرِّ كُلِّ نَفْسٍ أَوْ عَيْنِ حَاسِدٍ، اللهُ يَشْفِيكَ بِاسْمِ اللهِ أَرْقِيكَ

Bismillaahi arqeeka, min kulli shay’in yu’dheeka, min sharri kulli nafsin aw ayni hasidin, Allaahu yashfeeka, bismillaahi arqeeka

In the Name of Allaah I recite over you (to cleanse you) from everything that troubles you and (safeguard) you from every evil (that may harm you) and from the eye of the envier. Allaah would cure you and in the Name of Allaah I recite over you.” [Saheeh Muslim]

Destructive Envy and Eagerness (to acquire more)

Iblis said to Nooh (‘Alayhis-salām): There are five things that destroy people.

‘Abdullah Ibn ‘Umar (RadiyAllahu ‘anhu) said: While on the Ark, Nooh (‘alayhis-salam) noticed an old man whom he did not recognise.

Nooh (‘Alayhis-salām) inquired: ‘What brought you here?’

He replied: ‘I came to strike the hearts of your followers, so their hearts become with me, while their bodies with you.’

Nooh (‘Alayhis-salām) responded: ‘Leave, O enemy of Allah.’

Iblis said: ‘There are five things that cause people to become destroyed (deviated). I will inform you of three and not of the other two’.

{Then it was revealed to Nooh (‘Alayhis-salām) that he needed not know the three, but that he should enquire about the two. (so he inquired about just two)}

Iblis said: ‘The two that are certain to work are:

Envy: I was cursed because of my envy, and became a stoned devil and the second is

Eagerness (to have more): The entire paradise was made permissible to Adam (‘alayhis-salam). I got what I wanted from him because of his eagerness.’

Shaykh Ibn Taymiyyah رحمه الله said;


“The reason why the religion of Allah and its rituals is vanishing, and kufr and sin are prevailing, is because of imitation of the kaafireen, just as the means of preserving all good is by following the ways and laws of the Prophets.”

*Some Reasons Why Some Who Know The Truth Still Reject It*


Ibn Taimiyyah [رحمه الله] said:

❝A person might know that the truth is [found] with someone else; despite this, he outwardly denies that [truth] due to his envy for him, his wanting to be in a higher position above him, or [his having] desires in [his] soul.❞

Al-Khallaal said, “I heard Ahmad ibn Hanbal saying, ‘I had memorized the Quran. Then when I began seeking the narrations, I became busy.'” When he began seeking and memorizing the narrations, he became too busy to keep track of the Quran, and forgot some of it due to his occupation with the narrations.

“I had memorized the Quran,” said Imam Ahmad, “But when I began seeking the narrations, I became too busy for it, and it got away from me. So I asked Allaah, the Mighty and Exalted, to grant me its memorization, but I did not add, ‘in safety and good health.'”

He said, “O Allaah! Grant me the memorization of the Quran,” without adding, “In safety and good health.” He was saying that what is more befitting is to ask, “O Allaah! Grant me the memorization of the Quran in safety and good health.”

He said, “So then I did not memorize the Quran until I was shackled in prison. If you ask Allaah for something, ask for it in safety and good health.”
