The Legislated Knowledge

Question: Some individuals rely upon and study books of al-Fikriyyah (ideological thought) and ath-Thaqaafiyyah (educational and cultural sciences) then after that he presumes that he is an 'Aalim (scholar of the religion) and a Daa'iyyah (caller to Islaam) whilst he is weak in understanding of the religion and he has not studied the books of the Sharee'ah (Divine Legislation). So what is the advice of your eminence for the likes of that person?

The Shaykh Ibn Baaz rahimahullaah replied:

Knowledge is what Allaah said and what His Messenger said and it is not what so and so, and so and so says. Knowledge is what Allaah said and what His Messenger said, after that is the speech of the people of knowledge (Ahlul-'Ilm) by which they explain knowledge and clarify it to the people. The people of knowledge (Ahlul-'Ilm), after the Messengers, are Allaah’s Khulafaa (the appointed successors) amongst His servants.

The Mighty and Most High mentions:

Allaah bears witness that Laa ilaaha illaa Huwa (none has the right to be worshipped but He), and the angels, and those having knowledge (also bear witness to this); (He is always) maintaining His creation in Justice. Laa ilaaha illaa Huwa (none has the right to be worshipped but He), the All-Mighty, the All-Wise. [Surah Aali-Imraan: 18].

And true knowledge is to have knowledge of Allaah and His religion. He, the Most High, said:

It is only those who have knowledge among His slaves that fear Allaah. [Surah Faatir: 28].

And they are the Messengers and their followers (from) the people of al-Basaa'ir (insight and understanding), the people of religion, the people of truth and the people of the Qur'aan and the Sunnah. So the scholars are the successors of the Messengers and they clarify (the religion) and they direct to Allaah and His religion.

The student of knowledge does not become from the people of knowledge (i.e. scholars) except by learning and contemplating upon the Book of Allaah and the Sunnah of His Messenger (sallallaahu alayhi wasallam) and taking from the scholars of the Sunnah. This is the path of knowledge; that is occupying oneself with being upon obedience, contemplation, comprehension, gaining benefit and that he reads the books which are beneficial for the student of knowledge from the beginning to its end. He should contemplate, comprehend and carefully read that which is difficult for him in the reliable books of at-Tafseer (exegesis of the Qur'aan), like the Tafseer of Ibn Katheer and al-Baghawee and their likes from reliable books of Tafseer. He concerns himself with the distinguished books of Hadeeth and takes knowledge from the scholars of Ahlus-Sunnah wal-Jamaa'ah from the people of insight; and not from the scholars of al-Kalaam (rhetorical speech and philosophy) and not from the scholars of innovation or the ignoramuses.

So the knowledge that is not from the book of Allaah and Sunnah of His Messenger is not called 'ilm (knowledge) rather it is called Jahl (ignorance). Even though it may be beneficial knowledge concerning the Dunya (worldly matters); but the intent is (the knowledge) which benefits in the Hereafter, rescues from al-Jahaalah (Ignorance of the religion), through it a person gains insight into the religion and acquaints him to what Allaah has obligated upon him and prohibited him from. This is al-'Ilm ash-Shar'ee (the legislated knowledge).

The Evils Of Interest Based Loans & Mortgages

Question:
Is it allowed for me to take out a loan (Mortgage) from a bank that deals with interest to buy a house? Benefit us may Allaah reward you with good.

Answer:
Even if you were in dire need of eating a piece of bread to save yourself from death still don't borrow anything from the bank whatsoever, let alone buying a house or a car. When one is in an adverse situation forced by circumstance (severe hunger) Allaah has made lawful for you al-Maitah (dead animals), and the flesh of swine, and that which has been killed by a violent blow or by a headlong fall; yet ar-Ribaa (interest) has not been allowed for you, interest is very dangerous, very dangerous. So don't deal with interest and be patient; since Allaah the Perfect and the Most High mentions:

And whosoever fears Allaah and keeps his duty to Him, He will make a way for him to get out (from every difficulty). And He will provide him from (sources) he never could imagine. And whosoever puts his trust in Allaah, then He will suffice him. [Surah At-Talaaq: 2-3].

So dealing with interest is a grave sin, a dangerous matter and the one who makes it allowable has disbelieved. Therefore, if you are in need of a house then be patient until Allaah provides it for you, seek refuge in Allaah and utilise the necessary means until Allaah paves the way for you to obtain a house. Either that or you die being free from waging war against Allaah. Since the Muraabi (the one who deals with interest) is warring with Allaah - and Allaah’s refuge is sought - as Allaah the Perfect and the Most High mentions:

And if you do not do it, then take a notice of war from Allaah and His Messenger but if you repent, you shall have your capital sums. Deal not unjustly (by asking more than your capital sums), and you shall not be dealt with unjustly (by receiving less than your capital sums). [Surah al-Baqarah: 279].

He (Allaah) declares war upon the people of ar-Ribaa (interest) and "the Messenger of Allaah (ﷺ) cursed the usurper of interest, the one who pays it, the one who records it and the two witnesses to it." *

What do you want after the curse?!

Will the house benefit you when you are in front of the Hellfire?! So the believer should fear Allaah and should have patience upon his destitution and his need; for indeed Allaah the Perfect and the Most High mentions:

"And certainly, We shall test you with something of fear, hunger, loss of wealth, lives and fruits, but give glad tidings to the patient ones." [Surah al-Baqarah: 155].

Be patient and Allaah will give you this mighty reward instead of exposing yourself to His curse, His anger, His wrath and His punishment. Bear this severity in the world for it is nothing in comparison to the anger of Allaah and His punishment.

We ask Allaah that He protects us by His grace and favour from everything that incurs His anger and wrath. Indeed our Lord is All-Hearing of our supplications. And may the blessings of Allaah and peace be upon our prophet Muhammad, his family and upon his companions.

* Reported by Muslim in his Saheeh (11/36 no.1598 - Nawawee) from the Hadith of Jaabir radiallaahu 'anhu.
