Senate Bill 5, passed in March 2020. The Indiana Legislature gave authority to the County Commission in each Indiana County to determine the policies during a health emergency. That authority is NOT provided to the School Corporations by the Indiana legislature. Executive Orders and Mandates by the Indiana Governor do NOT override or supersede the law. The School Corporations have circumvented the law to participate in the ESSER funding. The EVSC stated in writing their authority to create draconian unconstitutional restrictions was afforded to them by Governor Holcomb and the CDC.
October 26, 2021..Dr Box, the CDC Foundation Board member hired by Governor Holcomb, circumvented the Indiana legislature Senate Bill 5. The Indiana Health Department intentionally, pre-planned, pre-meditated to contact trace, and restrict the individual body sovereignty, Constitutional rights of Hoosier Children. The EVSC participated,
The EVSC received the certified letter regarding FOIA #3. The letter may be found back in a previous post on this platform. EVSC received it on 2/16; the day before announcing the removal of the Illegal Face Mask Mandates on 2/17. The FOIA was extensive, but what resonates is the request of the Surety Bond certificates of each of the EVSC Board Members. They have until February 23, 2022 to provide this important one page document outlining the Insurance Company and bond number(s). If the documents are not received, a formal complaint and legal recourse by the Indiana Department of Insurance will be submitted. An additional Security and Exchange Complaint will be lodged against the local Insurance agency, Epic Insurance for denying a copy of the Government contract Insurance paid with taxpayers money. Opinion: It is absurd the difficulty in accessing these public records. The law is clear that the Surety Bonds must be recorded at the VANDERBURGH County recorder’s office.
Let’s discuss LEA = Local Education Agency. This is the entity within the EVSC responsible for utilizing the $85 Million in distributing ESSER funds throughout the schools. Interestingly the address of 2150 Stringtown, as displayed on the website, is located within the Butcher Shoppe on Stringtown. There are offices behind this privately held building, housing your favorite meat shop. Now, perhaps the address should be the old North High School, a block away, but the documents reflect a private office in the meat shoppe; Perhaps a FOIA to see the lease agreement between EVSC and the landlord? 🤔 Wonder if they get a discount on meat too? Lol. The VANDERBURGH Assessor’s website shows the building and office space being owned by WAH, LLC. The next series of posts will provide information on the “LEA” and the coordinating of using the ESSER funds.
Attached is a sample agreement between a School Corporation and the Federal Government to receive ESSER funding. The coordinator of the LEA program at EVSC is a woman by the name of Shelly Titzer. She received her degree in New York per the EVSC Website. We shall be exploring the responsibilities of the Local Education Agency.
