The following unredacted TEXT dialogue is with EVSC School Board member, Ann Ennis regarding her recent newspaper comment of “Transparency” within EVSC. ………..

Ken Colbert here. “Transparency”? I was amused when I read your comment. Interestingly the same attorney firm representing Warrick County Schools have provided the ESSER funding documents including their Surety Bonds. Same office as EVSC Attorney. You prostituted the children in exchange for compliance of perceived Federal Authority. Your Constitutional Rights are NEVER suspended. SB 5 outlined the legislative authority who has that authority. How dare my elected officials at the EVSC deny access for public comment or negate response to my inquiries. Mandates are NOT laws and the CDC has zero authority, contrary to what I have in writing from Smiths assistant. Interesting to find out that the EVSC Maintenance Staff signed “Confidentiality Agreements” to not discuss how the ESSER funds were utilized. You prostituted the students willingly based upon signed agreements with the Department of Education. I will get these signed contracts. I am speaking publicly about FACTS. It has NEVER been about “safety” and you know it. Wait till the public finds out about the Evansville Foundation and all the real estate given away and managed by Jeffery Berger, a non-elected official. The local newspaper is feckless in its duties to investigate. I had to literally have legislation drafted to demand the Indiana School Boards to allow public comment. Your office refused to place me on the agenda to speak at a public meeting. The law goes into effect June 1st, conveniently after the school board convenes for the Summer.

BTW school board meets all summer. And I think you meant “recesses for summer” not “convenes.”Because “convenes” means “holds meeting.”

… And we do — all summer. So I’m not sure about your point there?
We have two meetings in June and I believe two in July and I believe two in August. ( I’m not front of the school calendar right now.)

PS: I think the open comment law takes affect July 1. So did you have a typo there? But either way — we meet in July and in August and “convene” means “has a meeting.”

Thank you for the offer, but I will dialogue in a public setting, in the board meeting. I want it on record, in the minutes and in front of a quorum. Private meetings can be misinterpreted, just as the useless Townhall Meetings. The EVSC has my written requests and it’s intentionally being ignored. Imagine School Boards being comfortable in denying the right to censor the public in questioning their perceived superiority. The EVSC continues to be complicit. Those pesky Federal subsidies have a way of manipulating School Boards into ideologies not in the best interest of the taxpayers or students. I will see you at the Board Meeting. I never had an elected official deny access to my taxpayer funded appropriations either. I will expose the facts. I’ve asked for specific documents last year; crickets from my elected officials. You present yourself as the conservative on the board too. Lol.

One more thing, you are aware that public comment is not a dialogue, right? We take public comment but we do not engage in dialogue with the public during meetings.

Because there’s no reference material available to us during meetings. There’s no opportunity for us to look up answers to questions. It’s the same when one speaks to the General Assembly….

Just so you know that. The opportunity for dialogue is what I’m offering with a cup of coffee.

Ann, You are being condescending, no worries. It will not be necessary for The board to say a word. It will be my time. So perhaps the board should create a policy to limit the time to further censor, I’m not asking questions, I am making statements of truth.

EVSC has blatantly blocked public comment at their board meetings. They espouse you may speak at the "Town Hall Meetings" in advance with two board members; this is not a quorum and is not documented in the public minutes. Effective July 1st, 2022, the law goes into effect, passed by the Indiana Legislature, requiring a public comment period at the board meetings. It is pathetic that another law has to be created to simply require my elected officials to address questions.

One of the many documents requested from EVSC from the previously submitted FOIA will be the agreement between The Indiana Department of Education and EVSC. This agreement signed between the two Government agencies will reflect the protocols established to access the ESSER Funds. The release of the funds correlate with the compliance of the protocols. Every School District across the US had the ability to access these funds based upon the signed agreements.

There were three funding cycles at EVSC, each with specific protocols to be completed to access the money. Again the total allocation for just VANDERBURGH was $85 million. EVSC has received approximately $20 million thusfar per the Indiana State Board of Accounts. The agreement provides flexibility in spending the proceeds, but specific in the compliance requirements.

Look at the list of compliance items. The EVSC prostituted the children for money. They relied upon a “mandate “ issued by Indiana Governor Holcomb and the CDC “ to justify their position to blatantly violate the Constitutional rights of the children.

Remember Mandates are NOT laws and the CDC has zero authority. The Indiana legislature passed Senate Bill 5, “A LAW” which is the correct legally binding rule of law set forth in the Indiana Constitution and supported by the US Constitution was effective March 2020.

EVSC continues to withhold these important public records including Surety Bonds and/or Errors and Omissions insurance policies information . Each of the 7 Board members have received in writing the FOIA requests. I have requested to be placed on the agenda to confront my elected officials in a public forum, with witnesses, and documented minutes of the meeting; they have denied this request.

After July 1, 2022, the Indiana law demands the School Corporations throughout Indiana must allow for public comment.

If I were an elected official of the EVSC, I promise complete transparency and exposure of every taxpayer funded dollars being utilized, no matter the outcome.

Employees of the EVSC were required to execute confidentiality agreements regarding the expenditures of the ESSER funds. Imagine a gag order to not discuss the allocation of $85 million and a feckless newspaper that attempts to vilify a taxpayer as a “Conspiracy Theorist”.
