HIPAA Issues Can Arise with COVID-19 Vaccinations
HIPAA can become an issue if healthcare employers require proof that employees have received a COVID-19 vaccine. Under HIPAA, immunization records are protected health information.
Recently, many friends have brought up this issue of feeling pressure at work to get the jab. So I hope it's helpful for us to explore as a community?
This is not legal advice of course, but here is how I might respond if I were asked by my employer to prove vaccination status:
"I look forward to coming back to the office too. And what you're asking is personal private medical information.
Are you aware that violating HIPAA privacy laws could be subject to a fine of $50,000 per incident?
I know you're just doing your job. but this could get you and the company into serious trouble. I have a duty of care to let you know."
If they persist saying that it's for the "greater good" or "herd immunity" or it's the only way to open the office safely, you might consider to say:
"Are you aware that, according to the WHO, CDC, FDA documents, these injections for covid have not been shown to protect others by creating immunity or reducing transmission? They only modulate my personal symptoms. This is truly personal and private information on all levels. Please know that this is a serious breach of HIPAA medical privacy laws. I'd really hate to see you and the company get into trouble with this."

(They are only given half a day on the history and reasoning for vaccines while studying in advanced learning. Then any further instruction is for how to administer the shots. They apparently aren’t even taught about the VAERs reporting system. So the information obtained through VAERs isn’t even complete- only those aware are reporting.)
