If it weren’t institutionalized civil war (as seen in The Magna Carta, Declaration of Independence, and various Colony Charters) then what were the Founding Fathers doing when they wrote this provision into the Declaration of Independence:

Magna Carta provision - It mandated 25 barons to serve as enforcers of the great charter against the king.  If the king violated the provisions, the barons "shall distress and injure us in all ways possible - namely, by capturing our castles, lands and possessions and in all ways that they can."

The Founding Fathers were well aware of the Magna Carta as several provisions in the constitution were borne from that document.
