Brazilian court determines the blocking of Telegram in the country (despite Telegram forward the group creator data) The court ordered Telegram to send the phone (and IP) data of all members of 2 neo-Nazi groups in less than 24 hours. About the 1º group…
Although Telegram released IP and phone number from an user account to the Brazilian Court last year, untill now there is no report for Brazil on @transparency.
🇪🇸 Spain National Court orders the blocking of Telegram in the country
(despite it's unknown if Telegram was directly notified to manifest)
In 2023 a complaint has been filed in Spain National Court by Mediaset, Atresmedia and Movistar Plus (3 major Spain audiovisual companies) against Telegram, for infringement of intellectual property rights.
In 22 march 2024 Santiago Pedraz Gómez, judge of Spain's Court, ordered 10 Spain Internet Access Operators within three hours of receipt of the judicial communication to temporarily:
1) Block Telegram Web: https://web.telegram.org/k/
2) Block Telegram Messenger: https://telegram.org/
3) Disable and block the connection [IP addresses, protocols, ports and any other connection element], to suspend the operation of the "Telegram" application (app) from the connections from Smartphone and/or Tablet of the users who have installed the "Telegram" "app" on their computers, working from any operating system (Android, iOs).
The judge argues that:
🔹 Telegram was requested to identify the owners of accounts used for infringement of intellectual property rights but there was a lack of cooperation from the authorities of the Virgin Islands, which were asked to carry out a communication activity to those responsible for Telegram since July 28, 2023.
🔹 The measure of blocking the app has legal support in article 13.2 of the LECRIM which states:
"In the investigation of crimes committed through the internet (...), the court may order, (...) measures consisting of the provisional removal of illegal content, in the temporary interruption of the services offering such content or in the temporary blocking of them when they are located abroad."
Telegram's legal domicile is located in the city of Tortola (British Virgin Islands).
Telegram's operational center is located in the city of Dubai (United Arab Emirates).
Judge's order was sent on a Friday afternoon so it is possible that until Monday some of the internet operators do not receive the order and, therefore, the order may not be effective until then.
According to Santiago Menéndez-Abascal (Google's legal advisor in Spain) the court order can't fit in with recent rulings of the European Court of Human Rights (ECHR). Like the judgment in the case between Vladimir Kharitonov and Russia, which ruled:
"Where exceptional circumstances justify the blocking of illegal content, the country that issues the block shall ensure that the measure is strictly targeted to the illegal content and does not have arbitrary or excessive effects regardless of how it is implemented."
In this case I think it is clear that the judge order is against what was defined in the ECHR, won't block the infringement of intellectual property itself and will affect communication of 8.5 millions Telegram spanish users.

The🇺🇸 United States Subcommittee on the "Weaponization of the Federal Government" formed mostly by congressmen from the Republican Party made a report about 🇧🇷 brazilian judicial censorship.
The report include confidential files from Brazilian judiciary (most of them decisions that the brazilian judge Alexandre de Moraes sent to Twitter) requesting the blocking of accounts.
Alexandre de Moraes is the same judge who ordered the blocking of Telegram in Brazil in 2023.
Some of them address that the reasons for blocking those accounts are:
- fake news about electoral system
- false accusations of election fraud
- organizing a protest that ended in a attack on government buildings on January 8
But some of them:
- do not specify any reason for the blocking

- impose a daily fine of R$ 100.000 (~20.000 dollars) per day to the Social Media for failure to comply with the order.

What happened: These Telegram groups were used to organize a protest against brazilian congress and judiciary. Some of the protesters vandalized public building assets.
My opinion: Organize a protest to vandalize public building is illegal. The only groups that should be closed should be the ones where depredations of public assets and violence were stimulated. In this case, the judge closed all groups.

Why did Telegram change a video of the new update in the blog? 🧐
Yesterday (25/04/24) Telegram released a new update with 17 new features, including recommended channels, a way to view your own profile and display your channel and birthday on your page, improved moderation tools for group admins – and much more!
But this update drew attention on some social networks not for the features, but for one number. 1488, the number of subscribers of the example channel in one of the announcement videos.
According to Wikipedia the number "1488" is a code used by neo-Nazis and white supremacists to show their alliance with others in their movement. 14 refers to the 14-word statement: “We must secure the existence of our people and a future for white children.” and the number 88 refers to the fact that H is the eighth letter of the alphabet, so 88 is HH. This stands for "Heil Hitler".
Some even pointed out that the date "04/20" that appears bellow the number 1,488 in Telegram blog post should be a reference to Hitler's birthday.
Pretty obvious this is just a coincidence. 😅
Each Telegram announcement has hundreds of random numbers used only for the purpose of illustrating the new functions. The likelihood of appearing randomly a number with misrepresentation (like "420" for example, which stands for "weed legalization") is very high.
Today Telegram replaced this old video in the blog for this new one. The example channel now have 1,391 subscribers.
