More: "The information sought by the Court is subject to the state secrets privilege because disclosure would pose reasonable danger to national security and foreign affairs. Because there is no need for the requested disclosures, the Court must resolve the application based on the Cabinet level declarations submitted with this motion."
Keep in mind--Jeb Boasberg is very sensitive and accused Trump DOJ of being "intemperate" and "disrespectful" in its previous filings.
I hope he doesn't weep at this one.

A reminder that former FBI Director Chris Wray helped perpetuate the lie that nothing was wrong with Joe Biden. This testimony is from July 2024.
Just one of the many lies told by Wray during his disastrous tenure at FBI

McCarthy has not just misrepresented the indictment—insisting the charges deal with the McCabe leak not those of his good friend Dan Richman—but clearly cannot even explain the case just insists it’s lawfare.

I for one applaud Jack Smith for going public—especially this recent sit down with Andy Weissmann.
Watch how easily he lies and distorts the facts of both cases. Hur determined Biden willfully retained classified papers but wouldn’t prosecute because he was an old man with a failing memory (among other reasons)
Biden knew he had the papers and refused to turn them over until DOJ went after Trump. He had shared files with his ghostwriter, who destroyed tapes of his interviews with Biden AFTER the investigation began.
Smith LAUGHABLY argues one reason why the “rule of law” was different for Biden is because the documents were old?? Is he kidding?
Also—Trump fully cooperated with both NARA and DOJ to produce papers. He even let Jay Bratt and FBI agents into Mar a Lago to look for more documents in June 2022. Two months later, over the objections of some FBI officials, DOJ authorized the raid of MAL.
FURTHER — toward the end of the documents case before it was tossed—Smith’s prosecutors ADMITTED they did not know if any of the moved boxes (the basis of the obstruction charges) contained any of the alleged classified files seized during the raid. Smith’s entire farce was collapsing in Florida.
No wonder this guy is one of the biggest prosecutorial losers in DOJ history.

The judge presiding over the Comey criminal case just approved Comey's request to file a large motion to dismiss based on selective and vindictive prosecution.
Comey also has added some new heavy hitters to his defense team:
Rebekah Donaleski, a former unit chief at SDNY.
Ephraim McDowell, former assistant to the Biden Solicitor General and clerk for Elena Kagan.
Elias Kim, former general counsel in Biden's Department of Commerce.
Michael Dreeben, a former deputy solicitor general who worked on both Robert Mueller's investigation into Trump (he helped prosecute the Russian bot farms lol) and Jack Smith's team, where he argued on behalf of Biden DOJ in the presidential immunity matter.
Is this what you do when your case is a layup win?

NYT reporting an additional grand jury related to the "grand conspiracy" investigation led by US Atty Jason Reding Quinones will be empaneled in Fort Pierce, FLA where one judge will preside over the proceedings:
Judge Aileen Cannon.
Now I am old enough to remember how the media and social media influencers like Glenn Kirschner viciously attacked Cannon for her careful scrutiny of the documents case, This was back when it was cool to blast any judge for pushing back on government claims--now, of course, it's the exact opposite.
In Sept 2022, Cannon wisely appointed a special master to oversee sensitive materials seized during the MAL raid, expressing doubt over some of the Biden DOJ's claims and calling out DOJ leaks to media. (It was overturned on appeal but she was right all along.)
Then her cautious handling of the case post-indictment and her clashes with Jack Smith's team--she almost kicked David Harbach out of the courtroom one day after growing weary of his temper tantrums aimed at her--earned her increased ire by same "legal experts." She faced daily harassment including a petition drive by Kirshner demanding her recusal. A woman in Texas was charged and convicted for making death threats against Cannon.
Karma, as I always say, is a bitch.

NYT: "The people who sit on a grand jury in Fort Pierce, who would ultimately vote on whether to approve any indictments in whatever investigation it is used for, will be drawn from the five counties in that division. Strong majorities of voters in those counties backed Mr. Trump last year, while he narrowly lost the far more populous Palm Beach — the location of Mar-a-Lago. Mr. Trump overwhelmingly lost the vote in the Washington area, where many of the events of the Russia and election investigations took place.
If the justification for making Fort Pierce the venue is the search of Mar-a-Lago, that raises the question of whether the appropriate grand jury to use is one in the district’s Palm Beach division."
Excuse me while I get a big chuckle out of new concerns over proper venue for investigations after DOJ then Jack Smith conducted the entire documents investigation in Trump-hating DC to get every favorable judicial/GJ decision they wanted then switched to FLA a few weeks before indictment.
I also will say this does not mean Cannon will give this DOJ everything they want. She was tough on both sides during the documents case; she's very smart, prepared, and appropriately skeptical of most presentations before her court. This is not a layup for DOJ nor do I think they want one.
