As President, Trump has total immunity. But he's not President currently. That's Joe, as part of the Occupying Power. Trump *may* be Commander-in-chief of the military as the Occupying Force, need more sauce on that. Officially, Commander-in-chief is the highest ranked military officer in charge of the administration of Occupied Territory.
