It's interesting that Trump reTruths this video of Putin on December 17, 2023 which is the two year anniversary of when Russia sent the Russian Safety Agreement to the US on reducing NATO aggression.
The US would go on to deny the agreement outright and pull all diplomats, preventing any negotiations with Russia. This triggered the legal trespass on Ukraine to take on non-State actors (NATO) via the act of aggression in arming Ukraine.

War Crimes, such as Crimes Against Humanity, cannot be charged for offenses that occurred before conflict began BUT...
"...the United States could not institute a military tribunal within its own jurisdiction to pass upon violations of the laws and customs of war, unless such violations were committed upon American persons or American property..."
War Crimes/Crimes Against Humanity [traitors/spies violating the Constitution: census, voting, apportionment] on American property or people allows for military tribunals.
To charge Crimes Against Humanity before the conflict began, it must have been executed within jurisdiction of the tribunal, aka American property or people.
A state of war may exist prior to or subsequent to the use of force.
