“Since the handful of Republicans who voted against HB63 all seem to persist with the same inaccuracies at every turn... I'm going to correct some.
1. I can't find evidence of a single business being "warned 5 times". I suggest they call What A Bagel in Nashua who received zero warnings from the state government about a possible EO violation. Show me the "documentation" they were warned 5 times.
2. Shockingly, Brodie Deshaies says the businesses were fined $200-300. I think he's missing a zero. The smallest fine I can find is $500. Most were fined between $1000-2000, which is well documented on the DOJ website.
3. The fining mechanism of the state of emergency is predicated on EO65, which creates an entire judiciary system in the executive branch. This is plainly unconstitutional. And no, it has not been upheld in court. It has never even been heard in court as getting through the kangaroo court the governor set up has proven to be nearly an impossible task.
4. Yes, it has been upheld in court back in March that the governor can basically do anything with his EO's... but even AG MacDonald had to admit that that argument no longer flies, with more recent Supreme Court cases. Apparently an emergency is not an excuse to violate the constitution.
5. People have a duty to violate rules or laws (these are NOT LAWS) that are wrong. Plenty of "legal" things have been immoral throughout history. I applaud these harmless displays of civil disobedience. To use this "people shouldn't break rules" argument, sounds pretty fascist to me.
6. EO65 is wrong. It is the legislature's duty to correct wrong this wrong, thus HB63.
7. If the House passes HCR2, it doesn't immediately end the state of emergency. Whenever the state of emergency is over, it will not disturb the vaccine roll out. FEMA money is predicated on a state of emergency normally, but if we are in a NATIONAL state of emergency, that supersedes state requirement.
8. HCR2 does not require the governor's signature. It is a concurrent resolution.

Folks, the word is that HB 63, and HB 433 with parts of HB 275 have been amended into the budget. This combo punch would likely end the State of Emergency and drastically reduce the governor’s emergency powers going forward. It also slaps the governor on the wrist for creating his kangaroo court that tried to punish businesses who didn’t follow his illegal orders. Please call and email your reps and ask them to support the budget. It also has tax cuts and some other good stuff. If this sticks, it’s a major win.
Gov. Sununu just announced a 21-day extension to his mask mandate. Have you contacted your reps lately? Ask them how they intend to vote on the budget with amendments (the recent amendments change state of emergency laws and would end this madness).
