Deschler's Precedents is a vast parliamentary rulebook which governs the conduct of Congressional proceedings. In it's rules governing Electoral Counts, Deschler dictates what to do when a State sends TWO slates of Electors. The Vice President must read/present BOTH sets of Electors to the joint session and the joint session decides which slate to accept as valid.

If as Jack Smith contends, that the VP's role was "ceremonial" why does the VP preside over objections to the slates? If the State slates are sacrosanct, why is there even a procedure to object to the counting of said slates of Electors?

Sending separate slates or asking for separate slates does not make the separate slate "fake" or "fraudulent". Nor does introducing separate slates or objecting to the electoral count, constitute "Obstructing an official proceeding". Utilizing alternate slates and objecting to the count is PART OF THE PROCEEDING ITSELF. A President cannot by the very nature of his governmental position "corruptly" obstruct a proceeding of which he has interest!

IN FACT, the possibility of objecting to the electoral slate itself is written in as PART OF THE PROCEDURE. Whether Jack Smith finds it "democratic" or not, if a majority of both Houses of Congress agree, no matter what any prosecutor thinks, electoral votes can be thrown out. Arcane or not, it is PERFECTLY LEGAL and PROCEDURAL ACCEPTABLE. Therefore it cannot be criminalized by Merrick Garland, Joe Biden, or Jack Smith.
