The Supreme Court is set to hear two cases for oral argument this morning, one major gun case and one about arbitration agreements.
The major gun case deals with how the Court defines a bump stock and whether it’s constituted as a “machine gun” under 26 U. S. C. 5845(b). The outcome of the case could have implications on future gun laws.
Arguments in the first case begin at 10amET, here is a link to listen live as they happen: https://www.supremecourt.gov/oral_arguments/live.aspx

In retrospect, forget when we said that the Colorado Ballot case was the biggest case being decided this term.

NEW: In unusual circumstances, Supreme Court will announce one or more opinions in argued cases tomorrow morning at 10amET. The Court will not be taking the bench. Many legal experts are predicting a possible Colorado decision tomorrow.

(DISCLAIMER: As you know, for every opinion day until the very last one, we don’t know which cases will be decided because the Court doesn’t say so in advance. Any case could come down tomorrow, however due to Super Tuesday, the odds of it being Trump v Anderson are extraordinarily higher than the other previously argued cases.)

Good morning everyone, the Supreme Court is set to release opinion(s) in argued case(s) at 10amET. Since the Justices will not be taking the bench, any opinion(s) that are released will be posted immediately to the home page. As stated yesterday, we could receive any opinion from previously argued cases this morning, but we expect a ruling in Trump v Anderson. The decision could come down as a per curiam, which would explain why the Court will not be taking the bench for it. Any decision will be published here as soon as we have it!

BREAKING: In a unanimous decision from the Supreme Court, it has overturned the Colorado Supreme Court ruling barring former President Trump from the state’s primary ballot. The decision is a per curiam with no dissents. There are multiple concurrences.

In case you need a simple version of this opinion, for which would explain why it took long with concurrences. The court unanimously agrees that Colorado overstepped its authority, but the Court was split 5-4 on how exactly the issue should be addressed, or more specifically, who addresses it. The Per Curiam represents that Congress is the sole authority of deciding, while Justice Kagan, Sotomayor, and Jackson disagree.

BREAKING: President Biden has asked the Supreme Court to reinstate a lower court ruling, which was struck down by the Fifth Circuit Court of Appeals. The lower court ruling blocked a Texas law allowing the state to arrest any and all immigrants who cross over the border illegally. The “administrative stay” imposed by the Fifth Circuit gives the Supreme Court one week to decide whether to grant or deny the request made today.
Here is a link to the application for stay: https://s3.documentcloud.org/documents/24455809/23a814.pdf

NEW: Justice Alito has issued an “administrative stay” temporarily blocking the Fifth Circuit ruling. Justice Alito has asked Texas to file a response to the application on or before next Monday. The administrative stay expires next Wednesday. (NOTE: an administrative stay is not a merit decision, but more of a stall tactic to give the Court more time to properly consider the matter).

Happy Friday everyone, it’s opinion day!
The Supreme Court will convene this morning at 10 AM ET to deliver one or more opinions and argued cases this term. Unlike the previous opinion day, there aren’t many tea leaves to determine which cases we will receive. As always, when the opinion(s) are released, we will provide a link to it as promptly as possible! The justices will also be meeting privately for their regular Friday conference to consider petitions to grant or deny.

NEW: Here is the second opinion of the day, it’s O’Connor-Ratliff v. Garnier. This case, like the previous, concerned social media posts from state officials that included negative comments which were deleted. Likewise, the case is remanded with a set of standards to be applied. This case is from a different circuit, which corrected a circuit split. https://www.supremecourt.gov/opinions/23pdf/22-324_09m1.pdf
