BREAKING: President Biden has asked the Supreme Court to reinstate a lower court ruling, which was struck down by the Fifth Circuit Court of Appeals. The lower court ruling blocked a Texas law allowing the state to arrest any and all immigrants who cross over the border illegally. The “administrative stay” imposed by the Fifth Circuit gives the Supreme Court one week to decide whether to grant or deny the request made today.

NEW: Justice Alito has issued an “administrative stay” temporarily blocking the Fifth Circuit ruling. Justice Alito has asked Texas to file a response to the application on or before next Monday. The administrative stay expires next Wednesday. (NOTE: an administrative stay is not a merit decision, but more of a stall tactic to give the Court more time to properly consider the matter).

The case is called Murthy, Gurgeon Gen, v. Missouri and it deals with social media content moderation and government influence on it. Another hurdle though is article three standing, which requires the complaining party to have sustained an injury.
The justices will also hear arguments in another controversial case dealing with first amendment protections. The case is called NRA v. Vullo, a case about whether a government agency can threaten, with regulatory power, a regulated entity for doing business with a controversial speaker.

JUST IN: Fmr President Trump has submitted his brief on the merits to the Supreme Court about whether he enjoys Presidential immunity for official acts taken while he was President. All the amicus briefs in support of petitioners have been filed. Respondent’s briefs on the merits, as well as Amicus briefs in support of respondents are due by April 8. The case is scheduled to be argued Thursday, April 25 at 10 AM ET.
