Happy Wednesday Everyone!
The justices will convene to announce one or more opinions in argued cases, and hear one case for oral argument this morning.
The case is called Thornell v. Jones, which involves a deathrow inmate who made claims of ineffective counsel at sentencing. The justices will consider whether the Ninth Circuit Court of Appeals violated Supreme Court precedent Strickland. The question presented is as follows: Did the Ninth Circuit violate this Court's precedents by employing a flawed methodology for assessing Strickland prejudice when it disregarded the district court's factual and credibility findings and excluded evidence in aggravation and the State's rebuttal when it reversed the district court and granted habeas relief?
Arguments for the case begin at 10amET, here is a link to listen live: https://www.supremecourt.gov/oral_arguments/live.aspx

Happy Monday Everyone!
This is the final week of oral arguments for the 2023-2024 Supreme Court Term.
The justices will begin this morning with a case called City of Grants Pass. v. Johnson, which deals with a public camping ordinance involving homeless individuals. The justices will consider whether the enforcement of the ordinances/laws violate the eighth amendment prohibition against cruel and unusual punishment.
The justices will then hear oral argument in Smith v. Spizzirri, which involves a statutory question under the Federal Arbitration Act (FAA), the issue is whether Section three of the FAA requires district courts to pause the proceedings of a lawsuit pending arbitration, or whether the district courts have the authority to dismiss "when all claims are subject to arbitration".

Happy Tuesday Everyone!
The justices will convene to hear two cases for oral argument this morning.
The first case is called Department of State v. Munoz, which involves the Immigration and Nationality Act, which allows consular officers in the DOS to grant or deny non-citizens a visa application. The issue at hand is whether the refusal of such to a U.S. Citizen's non-citizen spouse infringes on the "constitutionally protected interest of the citizen".
The second case is called Starbucks Corp. v. McKinney, which deals with the National Labor Relations Act, which adjudicates complaints against employers for engaging in unfair labor practices. The justices will consider the following question: Whether courts must evaluate the NLRB's requests for section 10(j) injunctions under the traditional, stringent four-factor test for preliminary injunctions or under some other more lenient standard.

Happy Wednesday Everyone!
The justices will convene to hear two cases (consolidated) for oral argument this morning. Idaho v. United States and Moyle v. United States involve an Idaho law that prohibits access to abortions, and whether it is prohibited by EMTALA, a hospital policy requiring doctors and nurses to examine and treat patients in emergencies.
This is the first case directly impacting abortion (aside from the mifepristone case) since Dobbs v. Jackson Women's Health Organization, which ruled that abortion is not a constitutional right and can be subject to restrictions.
A decision in this case is likely by the end of June.

Happy Thursday everyone, welcome to the final day of oral argument for the Supreme Court’s 23-24 term.
In the most significant case of the entire term, the Supreme Court will convene this morning at 10amET to hear arguments in Trump v United States.
The case involves whether former President Trump has immunity from prosecution related to his alleged actions involving the 2020 election and the January 6 attack on the US Capitol. The justices will decide “whether and to what scope, a President, former or current, has immunity from prosecutions for what is considered to be “official acts” of the President”.
A decision in this case is likely to come down in June, however, due to its expedited circumstances, a decision could come sooner.
