A dismissal based on laches due to lack of proper service is curious. Laches is a equitable doctrine, which means it’s unfair to the defendant to wait so long the bring him into the suit. Daugherty’s lawyer argued he’d been trying to serve them “for months,” implying they’d been avoiding service. Which raises another issue- the defendant’s conduct in avoiding or obstructing the plaintiff’s attempts means the defendant may not have clean hands, such that he cannot raise equitable defenses. I’m surprised the judge didn’t take evidence on this.

AZ state Rep John Barnett proposes the Senate Judiciary Chair issue a warrant for routers and other items not turned over by Maricopa County:

“To get a warrant, we need a written report from the Chairman of the Judiciary Committee, Senator Warren Petersen, signed off on by Senate President Fann. Then we can send a Sergeant at Arms to go pick this stuff up. We don’t need courts involved.... “I have spoken about this with senators” and numerous lawmakers agree with the tactic, Barnett said. “They do NOT need to vote on it. The Senate Judiciary Committee chairman can issue the written report himself.”

Be vigilant at the local school board level. They know people are focused federally, but not locally. We must insist that CRT not be taught in our school districts.

Arizona Congressional Candidate John Barnett Pushes for AZ Senate to Issue a Warrant for the Evidence Maricopa County is Withholding | National File

John Barnett, a candidate Arizona’s 7th Congressional District and stalwart AZ audit advocate, proposes the Senate Judiciary Chair bypass the courts and issue a warrant for routers and other items not turned over by Maricopa County:

“To get a warrant, we need a written report from the Chairman of the Judiciary Committee, Senator Warren Petersen, signed off by Senate President Fann. He added that Arizona governmental super-lawyer Alex Kolodin confirmed that this tactic is proper and legitimate.

National File points out that “the Mason’s Manual of Legislative Procedure, which is recognized by the Arizona legislature as ‘a procedural and parliamentary manual that supplements the Constitution, statutes and House and Senate Rules,’ acknowledges that a Senate committee can issue a warrant. The Mason’s Manual states: ‘No affidavit charging contempt need be filed before a house to authorize it to issue its warrant to arrest a contumacious person who refuses to testify before one of its committees. The written report of the committee is sufficient authority for the issuance of the warrant.’”
