Ok everyone, buckle up. This was the response filed by the government today in the case we’ve been talking about - they are essentially saying that while a decision is being made on a religious exemption, the plaintiffs won’t be terminated, but if a decision is made to not accept an exemption, the plaintiff would have a certain number of days to get into compliance. It’s a mish mosh of word salad and no real protection against the heart of the matter, which is what this case is about in the first place. There is still an appeals process for redress etc, but stand by a second, because the judge just issued ANOTHER ORDER.

Essentially the judge just said, “not good enough”. The court is ordering the government to file another notice by 12PM tomorrow - indicating that they will agree that no plaintiff on the lawsuit will be disciplined or terminated pending the courts review on TRO - absent that, the court will likely GRANT the TRO - huge deal. Mike Yoder will be on the podcast tomorrow to discuss all of this, including instructions on how YOU should move forward if you are a government employee of any kind. Don’t miss it tomorrow at 2:30 ET. This is a huge development and great news.

See below for relevant text. This is the CORRECT response and it is what SHOULD happen in a just court. We are so used to corruption the right thing is an overwhelming victory. This is, so far, proving to be huge victory.

“Defendants indicate that plaintiffs will not be disciplined by their employers while their employers consider their exception requests. However, Defendants' notice provides no guarantee of what will happen to plaintiffs if their exception requests are denied and if they reach the point of being disciplined or terminated pending briefing of Plaintiffs' [5] Motion for Temporary Restraining Order ("TRO Motion") and Defendants' forthcoming motion to dismiss. Defendants indicate merely that they shall "notify the Court" if any plaintiff receives a final determination denying his or her request for a religious exception pending the briefing of and the Court's resolution of Plaintiffs' TRO Motion and Defendants' proposed motion to dismiss. It is not clear to the Court that this Notice sufficiently addresses the Court's concern that the Plaintiffs will not be disciplined or terminated while briefing is completed pursuant to the extended scheduled requested by Defendants. It therefore appears that Plaintiffs may be prejudiced by the proposed extended briefing schedule.”
