Update:
1.) the high def video the prosecutors deliberately withheld had-
A.) entirely different filename
B.) entirely different creation date
C.) altered/different metadata
D.) much larger file size
E.) different file type/extension.

It’s undeniable that the prosecutors just lied to the judge about withholding evidence. Exculpatory evidence they KNEW destroys their closing arguments & their case.

2.) the current legal team for Kyle attempted to verify & get the video from the drone company. The company owner lied to the investigator the defense team sent, refused to provide it, and later dissolved the company to avoid efforts by Kyle’s defense to gain the evidence.

3.) the prosecutors lied about knowing about the video quality difference. Kraus himself said during closing arguments and i quote “our video is better quality”.

4.) this judge is weak: there is ample technical & testimonial cause to dismiss this case RIGHT NOW with prejudice due to prosecutorial misconduct. Even if you chalk this up to incompetence it doesn’t excuse the Brady failure. This judge is holding back out of fear of the mob because hes weak.

5.) The jury WILL SEE the high definition drone footage proving that:
A.) kyle did not point his rifle at anyone except the the people attacking him
B.) that he did not point or fire until he was attacked in all cases.

This is a huge development.

Big Questions:

does mob threats win out?

does the judge refer the prosecutors for misconduct?

The Prosecutors knowingly sent a much lower quality of video hoping the defense would never find out, in order to hide exculpatory evidence from the defendant. They intentionally violated his brady rights.

RITTENHOUSE Update: ADA lists the videos requested by the jury (which do not include the drone footage):

Attempts are being made to solidify plan for jury to view materials as it does not include the videos still being questioned.
RITTENHOUSE Update: Court to take a break while a laptop is prepared with the jury requested files on a thumb drive to be viewed in their chambers, not in the courtroom. Judge Schroeder clarifies that the drone video in question has not yet been requested by the jurors for viewing.
