‘Powerful’ Dissenting Opinion by 6th Circuit Judge Likely to ‘Doom OSHA ETS’ According to National Law Review
Although the OSHA vax mandate stay was lifted in a 2-1 decision by panel of just three 6th Circuit judges, Judge CJ Sutton wrote a muscular dissenting opinion. The National Law Review summarizes:
“Judge Sutton argues that the clear-statement rule dooms OSHA’s ETS. Under that rule, Congress must clearly delegate to OSHA the authority to issue an ETS. He concludes that Congress did not clearly delegate that authority to OSHA in its enabling statue (the Occupational Safety and Health Act) or anywhere else.
Judge Sutton also points to OSHA’s failure to explain why the ETS was ‘indispensable’ or ‘essential,’ which he reasons is necessary for an emergency-rulemaking exception. He also writes that any such explaining would likely fail considering all the other ‘less intrusive, more tailored’ approaches the agency could have taken. Nor, in Judge Sutton’s view, was the ETS directed toward a true ‘emergency,’ as neither masking nor vaccination requirements are entirely new options available to the government.”
What’s interesting is that Judge Sutton delivered his anti-mandate opinion despite his strong, pro-Covid-vaccine stance: “The record also shows the utility of vaccinations. The medical studies to date show that vaccinated individuals face fewer risks of getting the virus and, for those who still suffer breakthrough infections, fewer risks of serious symptoms or death... But the issue here is not that simple. No matter the policy benefits of a well-intended regulation, a court may not enforce it if the agency’s reach exceeds a statute’s grasp.”
The National Law Review concludes, “Agree or disagree with his analysis, Judge Sutton’s thoughtful en banc dissent has emerged as the perhaps the most powerful (and the most narrow) judicial opinion against OSHA’s ETS.”
Law Professor Jonathan Adler agrees. In a Friday evening thread on Twitter, he commented, “Whether SCOTUS focuses on OSHA's specific statutory authority, or major questions doctrine, I suspect a majority will ultimately follow CJ Sutton's lead and stay the OSHA ETS, which can only last 6 months anyway.”
