CNN's Jake Tapper and Evan Perez discuss the Durham Report, which suggested no new charges, despite determining that the FBI and DOJ should never have initiated their investigation into Donald Trump, which falsely accused the former President of being a Russian agent:
"The report is now here. It has dropped, and it might not have produced everything of what some Republicans hoped for. It is, regardless, devastating to the FBI. And to a degree, it does exonerate Donald Trump."
"The bottom line finding from John Durham's four-year investigation is that the FBI moved very quickly to investigate these allegations of connections of collusion between the Trump campaign and Russia and that they did so by ignoring a lot of evidence that would have led them to drop that all together...
What he finds is that there wasn't enough there to support the FBI's decision to open a full-blown investigation of the Trump-Russia ties back in 2016.
He writes here he says that it seems highly likely that, at a minimum, confirmation bias played a significant role in the FBI's acceptance of extraordinarily serious allegations derived from uncorroborated information that had not been subjected to the typical exacting analysis that the FBI usually uses.
He goes on to say that the FBI discounted or willfully ignored material information that did not support the narrative of a collusive relationship between Trump and Russia.
There was a lot of very sharp criticism here of the former FBI leadership, James Comey and Andy McCabe, who were running the FBI and who oversaw a lot of these have a lot of the steps that the report goes into, Jake, but as you pointed out, bottom line, there are no additional charges....

I’m actually more optimistic about Abe Hamadeh’s election challenge than I am Kari Lake’s. Abe Hamadeh is represented by Jennifer Wright, former head of the Election Integrity Unit who is seasoned in this exact thing.
They’ve put together a strong case that thousands of provisional ballots were illegally discounted. Hamadeh only needs to prove 280 legal votes were not counted and that is enough to change the election outcome.
Hamadeh’s argument is simple, and if he’s granted a new trial and an inspection of the provisional ballots, he could easily meet the “clear and convincing” burden of proof.
On the other hand, I’m going to be honest with you, and I said this the day the AZ Supreme Court gave their ruling… Kari’s task of meeting Judge Thompson’s “clear and convincing” standard regarding signature matching is going to be unbelievably difficult.
She must prove that the signature verifiers conducted no signature matching whatsoever on at least 18,000 ballots. That’s near impossible when there will obviously be a rebuttal from Hobbs’ team claiming they did SOME form of signature verification. That apparently will be enough to sway the judge to rule in favor of the defendant (Hobbs).
Even a full inspection of mail in ballot envelopes won’t sway this judge because theres almost no way to make a “clear and convincing” argument regarding mail in ballot signature matching. One person could say they match, and another could say they don’t.
Given that the judge has already dismissed this count before, and recently dismissed the L&A count which would prove that the machines were intentionally manipulated, I’d say he’s not interested in hearing actual evidence of fraud.
On top of that, he also said that he’s inclined to view the evidence in favor of the defendant, so I’d say outlook not so good for Kari. Unfortunately.
