GAS ACT 1986 v ELEC ACT 1989
Deemed Contract

Automatic Formation:
Both acts state that if a person takes a supply of energy (gas/electricity) without an agreed contract, a deemed contract is automatically formed.

‼️Supplier Obligations:
Suppliers must ensure the contract terms are:
Clear, Fair, and Reasonable.

“CONTRACT TERMS”
If a supplier fails to provide the full contract terms, their ability to legally enforce charges may be challenged.

The Gas Act 1986 (Schedule 2B, Paragraph 8(1)) explicitly states that a consumer is deemed to have contracted for gas at the time they start taking supply, and that this cannot be used as a defense in criminal proceedings

THE TERMS & CONDITIONS FOR DEEMED CONTRACT

📌Gas Act 1986, Schedule 2B, Paragraph 11 states that a gas supplier must provide a copy of the deemed contract terms upon request, free of charge.

📌Electricity Act 1989, Schedule 6, Paragraph 3 states that deemed contract terms must be fair and reasonable, and customers must be made aware of them.

📌Consumer Rights Act 2015 further requires that contract terms must be transparent, fair, and not impose excessive charges.
