What people following Brett's group should notice are the problems they create for themselves by taking what should be a purely civil matter and merging it with a criminal matter, hence the term QUASI-CRIMINAL (aka traffic citations).

Everything they've done to Brett, regarding the traffic citation, is most likely perfectly legal, IF Brett was a legal entity that was organized and incorporated under the Texas State Statutes and conducting business in the forum State of Texas.

The problem arises, as you are seeing now through Brett's filings, because when those driving statutes were applied to Brett, it triggered a checklist of not only constitutional violations but of State and Federal criminal violations!

You need to understand that traffic court is an Administrative Law court that falls under the Executive branch of the State government and NOT the Judicial branch of the State government. Now in an Administrative Law court process, they can pick and choose what they want to follow and what they don't want to follow, which most often is perfectly legal, IF Brett was a CREATURE OF THE STATE, meaning operating a registered business or acting as an INDIVIDUAL acting for a registered business. So it's not that the statutes are illegal and you would never ever fight this matter saying they're illegal. The statutes are legal BUT the process of mis-applying them to Brett is ILLEGAL! Brett's remedies, unlike a CREATURE OF THE STATE, do not lie in those statutes. Brett haa inalienable rights not granted by the constitutions, only secured by them.

So there are 2 types of due process, substantive and procedural, and when they mis-imposed the Texas transportation codes upon Brett, they created a shit show for themselves because they are using a process called a SUMMARY OFFENSE PROCESS, which claims that for CERTAIN misdemeanors, such as traffic violations, they can bypass substantive and procedural due process of law and just issue ANYONE they deem to be in the State, a CITATION!

Nowhere in the State or Federal construction does a SUMMARY OFFENSE PROCESS exist! So this Summary Offense is nothing more than the State and their political subdivisions, the Municipalities, telling you that they're baking you an Apple pie, without having any apples! In other words, it's not only a SIMULATION OF LEGAL PROCESS, it's an IMPOSSIBILITY OF LAW!
