A ruling by the Higher Administrative Court in Münster, which is the top court for North Rhine-Westphalia, Germany, determined that a ban on questioning Israel's right to exist at a pro-Palestinian demonstration was unlawful.
The court clarified that denying Israel's right to exist does not in itself constitute a criminal offense under German law. The court emphasized that questioning the founding of Israel and advocating for peaceful change falls under freedom of expression and should not be banned; instead, such expressions must be assessed within their specific context.
The court found that "There is only one state—Palestine 48" could not be prohibited, lacking a direct link to Hamas and referencing historical events. However, banning "Yalla, yalla, Intifada" was likely lawful due to its potential interpretation as a call to violence in some contexts. For "From the river to the sea, Palestine will be free," the court indicated that a police ban could be justified if associated with a prohibited group.
