Forty-five Republican senators voted against holding an impeachment trial of former President Donald Trump over his remarks at the U.S. Capitol, saying it would be unconstitutional to impeach a former president.

All but five GOP senators sided with an effort proposed by Sen. Rand Paul (R-Ky.), sending a signal that there are not enough votes to convict Trump. Convicting a president during a Senate impeachment trial requires a two-thirds majority.

Republican Sens. Mitt Romney (Utah), Ben Sasse (Neb.), Susan Collins (Maine), Lisa Murkowski (Alaska), and Pat Toomey (Pa.) voted with Democrats to reject Paul’s order, suggesting the five senators will vote to convict Trump. Romney was the only Republican senator to vote to convict Trump during his first impeachment trial in early 2020.

The Senate ultimately voted 55–45 to table Paul’s point of order, meaning that the impeachment trial will go forward. The House voted to impeach Trump earlier this month on the sole impeachment charge of “incitement of insurrection,” with Democrats claiming he incited violence at the U.S. Capitol earlier this month. Trump called on the protesters not to engage in violent acts and later told them to “go home in peace.”

Trump is the first president to be impeached twice, and the first president to undergo an impeachment trial after leaving office.

Ahead of the vote, Paul warned that he wanted to force his colleagues to go on the record.

“If we are going to put every politician in jail, are we going to impeach every politician who has used the words ‘fight’ figuratively in a speech? Shame,” he said. “I want this body on record. Every last person here,” Paul added.

Elaborating, Paul added: “As of noon last Wednesday, Donald Trump holds none of the positions listed in the Constitution. He is a private citizen. The presiding officer is not the chief justice, nor does he claim to be. His presence in the chief justice’s absence demonstrates that this is not a trial of the president, but a private citizen.”

Sen. James Lankford (R-Okla.) issued the following statement after he voted to support Paul’s point of order on the constitutionality of the trial of a former president: “This is not a trial; this is political theater. You cannot remove someone from office who is already out of office. In this trial there is no current President, no Chief Justice, and no possibility someone could be removed from office because they are not in any office. In a moment when our nation needs to unite, this trial will only create even deeper divisions.”

While a number of Republican senators have faulted Trump’s speech to demonstrators as a group breached the U.S. Capitol during the Joint Session of Congress, many have said it’s problematic to impeach a president who doesn’t hold office.

Any Republican who votes to convict Trump is sure to face blowback among the GOP base—as Trump remains an enormously popular figure in the party. Rep. Liz Cheney (R-Wyo.) and about nine other Republican House members who voted to impeach Trump have faced significant criticism and primary threats.

Pushing back against Republicans, Senate Majority Leader Chuck Schumer (D-N.Y.) has stated that the trial is not unconstitutional. At least two Republicans—Romney and Murkowski—agreed with him.

“We need truth and accountability for Donald Trump’s actions. His impeachment trial will move forward in the United States Senate,” Schumer wrote on Twitter.

Several law experts—namely Harvard Law professor Alan Dershowitz—have argued the trial goes against the Constitution.
“It will be unconstitutional, but that probably won’t bother the senators,” Dershowitz told Fox News earlier this month. “The Constitution is very clear. The subject, the object, the purpose of impeachment is to remove a sitting president. And there are two precedents. One is very obvious. When President Nixon resigned in anticipation of being impeached and removed, there was no effort to impeach him after he left office.”

This morning is your last chance to write in to your MP if you haven’t already and encourage them to vote for amendments to the Covert Human Intelligence Sources Bill.

This Bill gives wide sweeping powers to people working undercover. With this Bill the Government have not limited the crimes that can be committed while working undercover meaning that they could commit torture or murder and not face charges for their actions. Not only that the criteria of when these powers can be used is vague and the bar is set as low as ‘to prevent disorder’ or ‘to protect the economic interests of the UK’. Furthermore these powers have been granted to a wide range of bodies who would seemingly have no need of them such as the Food Standards Agency and the Gambling Authority. When taking all of these points into consideration it is clear to see that this Bill enables corruption and abuse of the system which could result in the loss of life and further impinge upon our rights, liberty and democracy.

The Government had the chance in October to amend this Bill however they chose not to with amendments often being voted down by 60 votes. Thankfully the Lords saw sense and have brought forward even more amendments including to protect children and to allow victims to claim compensation.

These amendments will be HEARD TODAY!

SOUTH-WEST ENGLAND, United Kingdom, January 26, 2021 (LifeSiteNews) — The brain-damaged Polish Catholic at the heart of a right-to-life battle in England has died.

The deceased, known as RS, was disconnected from hydration and nutrition on January 14, a month after the expiry of a final stay of a December 15, 2020 court decision permitting the University Hospitals Plymouth NHS Trust to discontinue RS’s “medical treatment.”

The Polish national died earlier today despite weeks of litigation by his birth family and the Polish Government, as well as multiple petitions from people in Poland and across the world to the British Government to release RS into his government’s care. His family was notified of his death less than two hours ago.

An ill-named “Transparency Order” makes it illegal for anyone to publish details or photographs that threaten the anonymity of RS, his wife, children, doctors, hospital and members of his birth family. Nevertheless, the Polish media published photos and videos of the man in hospital as well as his first name. The many Poles who took the sick man into their hearts also referred to him as “nasz rodak” —our compatriot.

Roger Kiska of the United Kingdom’s Christian Legal Centre, which spent over £70,000 in the fight to preserve RS’s life, told LifeSiteNews that the organization is “gutted” by RS’s untimely passing.

“We are gutted by the death of R.S.," Kiska said via email.

“Our prayers are with his family. We hope that because of the family’s efforts that no other person will have to see their loved ones die in such an inhumane and degrading way,” he continued.

“We are grateful to Poland for all of the extraordinary measures it has taken to preserve his life. One must genuinely question the soul of a culture which views such measures as those that ended R.S.’s life as being an act of compassion. It is a sad day indeed.”

The legal and diplomatic struggle to keep the middle-aged, devout Catholic father alive has been described by more than one Polish commentator as a “battle with the Civilization of Death.” It involved the clash of RS’ warm-hearted Polish Catholic culture, which abhors euthanasia as a relic of the Nazi occupation, with the cold granite of contemporary British law.

RS fell into a coma on November 6, 2020 after suffering a heart attack and sustaining serious brain damage. Although the doctors who examined RS believed that he had only a small chance of progressing to a minimally conscious state, they also testified that he might live five or more years longer on life-support. By December 23, RS was capable of breathing for himself, so his life-support consisted of clinically assisted nutrition and hydration (CANH). Subsequently doctors disagreed over whether RS had been moving from a coma into a vegetative or into a minimally conscious state in late December.

‘RS will never achieve a meaningful quality of life’
The University Hospitals Plymouth National Trust, supported by RS’s legal wife, wished to discontinue his life-support because they believed that he would never, in the words of one specialist, “achieve a meaningful quality of life.” RS’s wife testified that her husband “never wanted to be a burden if he was seriously ill” and “would not want his children to see him in his current condition” but “remember him as an able-bodied person.”
RS’s wife also testified that he had said “that every life is precious and that you must hold on to life, and also that if anything happened to him, he would want all steps to be taken to save him.” However, she added that he said that “if he was beyond saving he did not want to be kept alive.” RS’s wife also told the court that “he would not regard removing treatment as removing life.”

However, RS’ birth family, including his mother, two sisters, and niece, remained adamantly opposed to the removal of RS’s hydration and nutrition. They pointed to his firm Catholic beliefs in the rights of the sick to life and to compassionate care. They testified that RS was opposed to abortion and euthanasia. RS had also disagreed with a court decision to end the life of Alfie Evans through the withdrawal of his life-support.
