🚨Undated Pennsylvania mail-in ballots should not be counted, appeals court rules

Pennsylvania mail-in ballots that are not dated on the outside envelope by the voter should not be counted even if they arrive at a county election office on time, a three-judge appeals court panel ruled on Wednesday.

The 2:1 decision from the U.S. 3rd Circuit Court of Appeals strikes down a lower court ruling and sets up a potential Supreme Court battle over Pennsylvania’s mail-ballots that began in 2020.

Judge Thomas Ambro wrote in the decision Wednesday: “Because the date decision is irrelevant to whether a vote is received timely, the blink response is to believe a voter’s failure to date a return envelope should not cause his ballot to be disqualified… But the provision only applies when the state is determining who may vote, and does not apply to rules, like the date requirement, that govern how a qualified voter must cast his ballot for it to be counted.”

Ambro also noted that the date requirement “serves little apparent purpose,” but since the state’s Supreme Court ruled that dating of envelopes was mandatory, “undated or misdated ballots are invalid under state law and must be set aside.”

Delaware Court Asked To Reopen Case Seeking Biden’s Senate Records Following Special Counsel Report

The Daily Caller News Foundation (DCNF) and Judicial Watch asked a Delaware court this week to reopen their case seeking the release of President Joe Biden’s Senate records, held at the University of Delaware.

In July, the Delaware Supreme Court previously sided with the university shielding the documents from release.

DCNF Editor-in-Chief Michael Bastasch said: “The stunning revelations from the Hur report extend beyond the president’s memory lapses and mental state. The court needs to reopen this case to determine whether the University of Delaware lied.”

Documents requested by the DCNF included:

✔️Agreements relating to the storage of 1,850 boxes and 415 gigabytes of records from Biden’s 1973 to 2009 Senate career
✔️Communications between university staff and Biden’s staff
✔️Log sheets of individuals who have visited the collection
✔️The actual collection records.
