The term "nuclear option" in Congress does not refer to the use of nuclear weapons but rather to a procedural maneuver in the U.S. Senate that allows a simple majority to override a standing rule, such as the 60-vote threshold to end debate (cloture) on most legislation or nominations. This procedural tool can be used regardless of whether the United States is at war or not, as it pertains to internal Senate rules and not military or wartime powers.

The nuclear option was notably invoked in 2013 to lower the cloture threshold for most presidential nominations to a simple majority, and again in 2017 to extend this change to Supreme Court nominations. It relies on a parliamentary procedure where a point of order is raised, appealed, and then overturned by a majority vote, thereby establishing a new precedent.
