Save Jobs USA, an advocacy group for American tech workers, is suing on the grounds that the policy unlawfully undercuts American workers. The Department of Justice is opposing them.
The policy, introduced under President Obama’s administration, allows spouses of H-1B workers on H-4 visas to obtain work permits to work legally in the US, while their children under 21 can live in the US and attend school.
