Today is a good day to learn about one of the worst Supreme Court decisions in recent history:
Tennessee v. Garner (1985)
Most of American history used the "fleeing felon" English common law standard: if you engage in fresh pursuit of a thief without unreasonable delay, then you can use lethal force.
In 1985, the Supreme Court invented a new standard. It said that under the Fourth Amendment, shooting a fleeing felon was an "unreasonable seizure".
This was not what the Founders meant. This was not considered "unreasonable" at any moment before that moment in time. This was not an originalist interpretation. This was six men inventing a new standard, from whole cloth.
So now it's illegal to shoot a felon who is running away from you everywhere in America. Even if your state says it's legal, too bad.
Even worse, it's basically impossible to change. It would take a constitutional amendment or the Supreme Court overruling its own recent precedent to change it, two incredibly unlikely events.
So now good men like Orest Schur go to jail, while criminals can steal without fear.
