Documented: Biden’s memory loss dates to 2015, 25th Amendment territory

President Joe Biden has apparently been suffering substantial memory loss for nearly a decade, a new report from special prosecutor Robert Hur has documented.

In his report about the president mishandling classified information, Hur gave repeated examples of the president’s forgetfulness, even on some of the most significant episodes in his life.

For example, he said that Biden in interviews could not recall when he was vice president, when his son Beau died, or even who his allies in government were.

The report has prompted calls for an analysis of Biden’s mental condition, and some have suggested that he be sidelined under the 25th Amendment.

Thursday’s bombshell report by Special Counsel Robert Hur concluded that “President Biden willfully retained and disclosed classified materials after his vice presidency when he was a private citizen.” And though the material concerned “issues of national security and foreign policy implicating sensitive intelligence sources and methods,” and presented “serious risks to national security,” Hur recommended against charging Biden in his 380-plus-page report, saying it would be “difficult to convince a jury” to convict such “a sympathetic, well-meaning, elderly man with a poor memory.”

Mark Zwonitzer — who collaborated with Biden on his memoir "Promise Me, Dad" — erased audio files in his possession that contained "significant evidentiary value," according to a report published by Special Counsel Robert Hur.

Zwonitzer admitted to the FBI that he "was aware that there was an investigation" when he deleted the evidence.

CNN folks are REALLY struggling 🤣🤣: CNN's 75-year-old anchor Wolf Blitzer was seen looking pale and retching on camera while hosting his show - forcing the channel to abruptly cut to a commercial break.

Blitzer was on-air with House Oversight Committee Ranking Member Jamie Raskin (D., Md.) when he was seen uncomfortably swallowing and looking queasy as he attempted to avoid vomiting.

The Situation Room host struggled to contain himself for a full minute before CNN cut Blitzer's feed and left Raskin to finish his final comments on his own.

Special counsel Jack Smith is asking Judge Aileen Cannon to reconsider a ruling that would allow former President Trump’s legal team to publicly disclose witness identities and their testimony to the court docket.

Trump’s lawyers have sought to attach evidence given to them during the discovery process in other court filings set to be publicly posted in connection with the Mar-a-Lago documents case.

The Justice Department argued late Thursday that Cannon erred in her legal rationale for allowing them to do so, a decision they say risks exposing some two dozen witnesses to harassment, as she requires no redactions.

Second, Jonathan Mitchell did an excellent job. His sincerity and commitment to principle shown through in a way that was credibility enhancing. I wondered why he did not lead with the Griffins case argument, but that became apparent later. /2

Third, a lot of commentators need to take a slice of humble pie. After reading legal commentators (across the spectrum) deride the meaning-of-officer argument as frivolous I was not surprised to see the Supreme Court take it seriously. Kudos to @JoshMBlackman and Tillman

Fourth, back to the Griffins Case, I referenced above, I think that the Court is likely to proceed down that path. Congress needs to pass executing legislation. Mitchell was not sure that was required by first principles but this is the cleanest SCOTUS opinion to resolve this. /4

My prediction: The Court will let Trump on the ballot in an opinion that embraces both Originalism and the prudential concerns for taking a major party candidate off the ballot. For those that want to defeat President Trump in 2024 they will have to do so at the ballot box. /5x
