For my Brazilian friends out there:
Guys, I know that there are a lot of people concerned about the new income tax rules on crypto here in Brazil and as the text of the law has already changed a few times it has generated confusion among people. We can't put the hammer on anything yet, but here is some information about what appears to be the new reality stipulated by the law:
The law focuses mainly on "financial investments in crypto abroad made by individuals" and, in the current text, 15% of the annual income on assets abroad will be charged. In this case, there will be no type of exemption.
As the law refers to individuals, a loophole found was the registration of an account with foreign brokers under a CNPJ, in this case, even with the money in a foreign broker, the old rule and other taxes applicable to the different types of companies would apply.
For those who have crypto in brokerages abroad under their CPF, the government gave the opportunity to pay 8% of the profit instead of 15% as will be the case next year, if this 8% payment is made in December. In my view, it doesn't make sense to use this rule since you would be accounting for a "likely" profit for the year 2024, since the fluctuation of assets could change completely and thus you would be paying 8% on a profit that didn't even exist yet. In this case, I recommend that you take ALL your assets from foreign brokers and send them to the ledger.
No tax will be charged on exchange rate variations, i.e. the tax rule only applies to realized profits.
Money in metamask is not considered an asset abroad, there is no way to tax what you sell directly on the blockchain.
Binance is headquartered in Brazil and can be interpreted as a national broker as it informs the government the IN 88 demands, so, as it seems, for transactions and withdrawals on Binance the old rule remains: exemption of up to 35 thousand of monthly profit.
That's what we have so far.
