This fantastic interview explains why the Bill of Rights is more powerful than the Charter (which is not in effect, in any event, because the Constitution Act, 1982, has NEVER been enacted because it is still subject to a condition - this land is run by the queen's service corporation called 'Canada', foreign registered in Washington DC). We learn that the Charter allows the courts to override your rights and for the courts to invent a remedy. MOST IMPORTANT: the Charter speaks of rights granted by the government to its citizens (which, if granted, can be removed) versus or INALIENABLE rights as man and woman, set out in the Bill of Rights.
