Another valiant leader in the fight, Attorney Leigh Dundas of Advocates for Civil Rights, points out that the legislation on medical experimentation on human subjects is a criminal statute. Experimentation without informed consent is punishable by six months in jail or a $50,000 fine or both. Mandating immunization with unapproved vaccines amounts to forcing people to subject themselves to medical experimentation – a criminal act.

Besides, Ms. Dundas notes, “40% of residents over the age of 65, 20% of the poor, and 15% of most minorities don’t own smartphones.” Therefore, requiring people to show a QR code on an app is “impractical and discriminatory as a significant percentage of the population can’t even show proof of vaccination.” Adding that everyone has a right to freedom of movement in the community, she wonders why vaccination against COVID-19 should be a requirement for entering a place of business when negative tests were never demanded for tuberculosis, also an airborne disease like COVID-19.

According to experts, Mount Nyiragongo is an active stratovolcano with an elevation of 3,470 m in the DRC's famed Virunga Mountains associated with the Albertine Rift.

It is located inside Virunga National Park, in the sprawling Central African country, about 20 km north of the town of Goma and Lake Kivu and just west of the border with Rwanda.

Lava from a volcanic eruption approached the airport of eastern Democratic Republic of Congo’s main city of Goma late on Saturday, and the government urged residents to evacuate.

As the red glow of Mount Nyiragongo tinged the night sky above the lakeside city of about 2 million, thousands of Goma residents carrying mattresses and other belongings fled the city on foot - many toward the frontier with Rwanda.

Nyiragongo's last eruption in 2002 killed 250 people and left 120,000 homeless. It is one of the world's most active volcanoes and is considered among the most dangerous.

History of Geology: Nyamuragira and Nyiragongo: History of two dangerous volcanoes

Many active, dormant and extinct African volcanoes are like the pearls of a necklace located along the Great Rift Valley, an active rift which almost splits Africa in half.

It's in the mid position of this rift-system, near lake Kivu, that the most active and dangerous African volcanoes can be found, the Nyiragongo (3.469m) and the Nyamuragira (3.085m). The Nyamuragira erupted between 1894 and 1979 for fifteen times (and is still active) forming large lava-streams (well recognizable on satellite imagines), however not affecing a densely populated area. In contrast the last eruption of the Nyiragongo in the Democratic Republic of Congo in January 2002 killed more than 100 people and caused great havoc in the nearby city of Goma - a foreseen catastrophe.

The same can be said of the people, many of whom live in a densely populated region near the city of Goma and Lake Kivu, which is poisoned by volcanic gasses.

I am using the example of Murphy [Governor of New Jersey] in order to address the concept of emergency powers, but there is no hyperbole here. Murphy quite literally issued executive orders barring folks from doing what the Constitution guarantees them the right to do, and he imposed criminal penalties for violating his orders, and he had folks who defied him arrested and prosecuted. Stated differently, he assumed the powers of the state legislature — which is to write the laws — and he violated his oath to uphold the Constitution.

He claimed that somehow he can interfere with the exercise of basic human freedoms — like going to church, going to work, shopping for food, operating a business, assembling and traveling — because he declared a state of emergency.

If the government declares an emergency, can it thereby acquire the lawful power to interfere with constitutionally guaranteed freedoms? In a word: No.

If government officials could declare an emergency whenever they wished and thereby be relieved of the obligation to defend the Constitution — and the rights it guarantees — then no liberty is safe.
