DoD Directive 3150.08 "DoD Response to U.S. Nuclear Weapon and Radiological Material Incidents"
A nuclear weapon incident is, as defined:
"An intentional act attempting damage, theft, unauthorized use, unauthorized movement, or loss of control of a nuclear weapon or nuclear weapon component involving suspected criminal or terrorist activity."
So if the FBI announces that this is what they were looking for...

(4) Support the Department of Justice, through the Federal Bureau of Investigation (FBI), when approved by the Secretary of Defense, by providing DoD resources through the authority in Section 831 of Title 18, U.S.C.
HOW DO YOU ‘legally’ inject/make public/use as evidence?
Military evidence
Federal military commanders, the DoD Component heads, and other responsible DoD civilian officials may use immediate response authority to support civil authorities in efforts to secure, control, and remediate the site of incidents involving U.S. nuclear weapons and nuclear or radiological material in DoD custody.

DoD policy is to approach ALL nuclear incidents (theft, loss of control, involving suspected criminal activity) as if they could be the result of a hostile act until determined otherwise.
