The appellate held the activist could be held liable under a theory of negligence, saying, “To recap, where a defendant creates unreasonably dangerous condi-
tions, and where his creation of those conditions causes a plaintiff to sustain
injuries, that defendant has ‘directed’ his own ‘tortious activity’ … In these circumstances, imposing liabil-
ity goes far more to preventing tortious conduct than it does to suppressing
any legitimate expressive activity.”

The 5th Circuit returned the case to the lower court for a trial on the merits.
