BUSH MADE LAW TO INVADE THE HAGUE

Pressure’s mounting on Israel as international courts examine accusations of war crimes in Gaza. However, don’t hold your breath if you expect to see world leaders behind bars as a result.

Firstly, the International Court of Justice currently hearing South Africa’s claim Israel’s committing genocide, does not have the power to prosecute and looks at crimes committed by countries. Secondly, even if the International Criminal Court, which can prosecute individuals, does decide to hold Israeli and their American accomplice to account, the US military has their back.

Continued….That’s because in 2002 US President George W. Bush signed into law the Service Members Protection Act. It allows the US to use ‘all means necessary’ to bring about the release of any US or 'allied persons' being held by the ICC. And that includes Israeli officials. So, in effect, it threatens military action against The Hague-based organisation.

It’s a frightening law and they still might need it, despite pulling out of the ICC. That’s because member states, like South Africa, would be obliged to arrest anyone subject to an ICC arrest warrant, which in turn could make them a US military target. A shocking scenario.

Fittingly, Bush’s law has been dubbed 'The Hague Invasion Act’ and was introduced to protect America and the UK ahead of their illegal invasion of Iraq. Will it be a factor in determining whether justice is served this time?

South Africa has initiated proceedings at the International Court of Justice against Israel, accusing it of genocide in Gaza. Apart from it being the morally right thing to do, South Africa indeed has a bone to pick with the Israeli occupation. While Africans were fighting to rid themselves of apartheid in South Africa, Israel backed the racist settler colonial regime. ICJ TRIAL: SOUTH AFRICA ACCUSES ISRAEL OF GENOCIDE

This morning, 11 January 2024, South Africa took a bold stand before the whole world as it publicly accused Israel of committing genocide against Palestinians in the Gaza Strip. This took place during the first of two days of public hearings being held at the International Court of Justice.

In this video clip, South African lawyer and legal scholar Tembeka Nicholas Ngcukaitob addresses the courtroom and the world, arguing Israel is clear about its genocidal intent toward Palestinians. He came prepared with evidence, including video clips of Israeli soldiers chanting,

Continued…..'There are no uninvolved citizens,' which South Africa says reveals Israel is not aiming solely at H*m*s, but at civilians, as well. In the last three months, the Israeli military has killed more than 23,000 Palestinians in the Gaza Strip.

South Africa's legal team stated during the opening of this trial that it relates deeply to the suffering of the Palestinian people and feels a moral obligation to speak up due to their own history under more than 40 years of apartheid. Palestine rallied behind South African freedom fighters by supplying material and political support during that time. More recently, South African parliamentarians voted to close the Israeli embassy in Pretoria and cut diplomatic ties with Israel. This is the South African legal team - after its historic first day in the International Court of Justice, prosecuting Israel for alleged genocide.

Pretoria wants the ICJ to order Tel Aviv to halt its destructive air and ground campaign in Gaza, arguing that the Israeli leadership intends to destroy the population.

The civilian death count in the Strip already exceeds 23,000 - 10,000 are child casualties.

South Africa’s lead attorney, in his opening statement, drew parallels between his country’s suffering under the apartheid regime and the Palestinian people’s subjugation by Israel.

‘S. AFRICA NOT FREE TILL PALESTINE IS’ - JUSTICE MINISTER

South Africa’s justice minister has channelled his nation’s founding father Nelson Mandela - saying that his country will be free only when Palestine is free.

South Africa has won international praise for prosecuting Israel for genocide in Gaza at the International Court for Justice. Ronald Lamola is part of the team that presented Pretoria’s historic case in the Netherlands on January 11th.

South Africa believes it has enough evidence to demonstrate genocidal intent on the part of the Israeli leadership, as well as genocidal war crimes by Israeli forces in Gaza. Tel Aviv insists its war is intended only to eliminate the militant H*m*s network.

Continued….Both Israel and South Africa are signatories to the 1948 Genocide Convention, which defines genocide as “acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group.”

Pretoria is urging the ICJ to order an emergency halt to Israel’s campaign - but many across the world hope the case will be a watershed that sees Israel and its Western enablers brought to book for their atrocities against Palestinians.
