Judge throws out ACLU lawsuit against Indiana tenure law

A U.S. District Court judge in Indianapolis dismissed a lawsuit challenging a controversial new state law that university professors say violates their constitutional rights.

The law requires faculty to include a variety of opposing political viewpoints in the classroom or risk losing their tenure protections. It also creates a system for students to submit complaints to the Indiana Commission for Higher Education about faculty they think are not following the law Indiana Attorney General Todd Rokita, who intervened in the case last week, said the law will foster diversity of thought.

The American Civil Liberties Union of Indiana is representing four Indiana professors who say the law violates their First and Fourteenth Amendment rights.
While the lawsuit targeted the trustees of Indiana and Purdue Universities as the enforcers of the new law, Rokita said the suit should be dismissed because the professors have not been harmed.  

Judge Sarah Evans Barker agreed that the the plaintiffs’ claims “are not ripe.” 
She cited a federal rule that limits courts to resolving “concrete disputes” rather than “answering legal questions, however important” before actual injuries have occurred. In other words, the professors need to show that their constitutional rights have already been infringed.

The ACLU argues that’s already happening. The very threat of punishment, it said, is already causing professors to self-censor. 

Barker cited a 2013 US Supreme Court case which ruled that “respondents cannot manufacture standing merely by inflicting harm on themselves based on fears of a hypothetical future.” Since the Boards of Trustees haven’t yet created policies for how to comply with the law, she said it’s impossible to know if “Plaintiffs do in fact have an ‘objectively good reason for (…) self-censoring.’”

In a statement last night, the ACLU said it was “disappointed” by the dismissal and is considering next steps. Communications Manager Laura Forbes declined a request for interview.

COLBERT COMMENT: The ACLU complaint being thrown out by the judge is great! The “thought police” (professors) at IU and Purdue will absolutely be held accountable to suppress the first amendment of students with opposing viewpoints. Kudos to Indiana Attorney General Todd Rokita in another win for the State of Indiana.

The liberal den of academia is being exposed. The Monroe County Sheriff is displaying his wokeism by supporting illegal immigration and against the rule of law. AG Todd Rokita is legally pursuing this corruption. Inquiring minds want to know if the IU “professors” provided campaign contributions to the local sheriff?

159 Countries Set to Adopt BRICS New Payment System

Amid the alliance’s continued efforts to create a SWIFT alternative, the economic alliance has sought to create its very own BRICS payment system. It will play a major role in the alliance trade dealings. Specifically, allowing unilateral settlement to be done without the need for the US dollar.

The move is poised to be vital for the bloc and participating nations, and it appears there will be a lot of them. According to one Russian official, there are already 159 countries seeking to adopt the system currently. With a potential launch coming in October, it could have massive global market ramifications.

Ummm…there’s 198 total countries on the planet…and 80% are set to adopt BRICS new payment system…

Eliminating the fiat dollar is imminent (IMHO)!

Connecting the dots with Senate Bill 4 and the medical tyranny of both physical and mental health weaponization for money 💰 and control in Indiana.

Have you wondered why the former Indiana Governor nominee Suzanne Crouch’s campaign promise was primarily focused with creating a mental health crisis in Indiana and allowing copious amounts of taxpayer money to fund the agenda?

The connection is infiltrating a captive audience in the prisons and the schools. Indiana HB1006 is a bill to provide mental health services to prisoners. The bill is co-authored by Representative Wendy McNamara, an employee of the Evansville VANDERBURGH School Corporation and a supporter of Senate Bill 4 which provided the conduit for abdication of local health departments to the Indiana Health Department overseen by the CDC Foundation Director, Dr Judith Monroe.

Representative of McNamara is perfect to coordinate such legislation and bridge the vulnerability of our society in the schools and prisons.

The Southwestern Behavioral Healthcare, Inc has been tracking and amassing data on the low-income being referred to mental health services. Indiana Representative, Cindy Ledbetter, as a full time mental health professional, assuredly can attest referrals have exponentially increased after she voted for Senate Bill 4 and supportive of Senate Bill 1.

As you recall, Suzanne Crouch’s personal friend, Senator Vaneta Becker advocated and sponsored Senate Bill 4 which created an opportunity for wealth building and control within the medical and psychiatric community. Senate Bill 1 and Senate Bill 4 is an opportunity to further control Hoosier Heath and provide financial windfalls to those involved in the industry. As you recall, Senator Becker repeatedly stated NOONE was against the legislation. Perhaps ask the mother of Haley Brinkmeyer, she absolutely has a different point of view.

By allowing the “Gender Identity Club”, renamed the Gay and Straight Alliance in Reitz High School in Evansville, Indiana, this is an opportunity for additional “patients” to be recognized as having “mental health issues” and referred to those professionals profiting off the taxpayers. Shameful!

Indiana’s state motto is “The Crossroads of America,” and for years police have exploited one of the nation’s biggest shipping centers to profit from that status. Indianapolis is home to the second-largest FedEx Express hub, where 99,000 packages from all over the country can be processed in a single hour.

There, law enforcement officials pluck packages from conveyor belts, run them past K-9s, and, if a dog alerts and the officers find cash, the county prosecutor’s office begins civil-forfeiture proceedings in Indiana state court to keep the money.

The prosecutor’s office does not tell the owners what crime was allegedly committed to justify forfeiture or what facts support its allegations that the cash is linked to a crime. To make matters worse, the parcels and their owners usually have no connection to Indiana other than the happenstance that FedEx routed the parcel through its Indianapolis hub.

Henry and Minh Cheng fell victim to this profiteering scheme in early 2024. The husband and wife own a small wholesale jewelry business in California. They’ve been running their business for three decades. They made a bulk sale of jewelry merchandise to one of their retail-jeweler customers, in Virginia, who eventually paid for the order by placing cash in a parcel and mailing it through FedEx to Henry and Minh in California.

The parcel was seized by an Indianapolis police officer at the FedEx hub, and the prosecutor in Indianapolis began forfeiture proceedings to keep the cash. But the prosecutor’s office has not identified (and cannot identify) an Indiana crime that serves as the basis for forfeiture.

Now, Henry and Minh are teaming up with the Institute for Justice to get their money back and to end Indiana’s profiteering. Americans should never have to prove their innocence to keep their property. Yet, civil forfeiture turns justice on its head, making cops into robbers rather than crime fighters.

A lawsuit just got filed against the Wisconsin Election Commission and the DMV for failing to verify if voter registrants are US citizens

According to official data, over 72,000 “permanent non-residents" in the state have IDENTICAL driver’s licenses compared to U.S. citizens, according to Election Watch President @PeterBernegger. He also says the number could be as high as 300,000

The Wisconsin Department of Transportation still refuses to allow the legislative election committee to review the names. Anyone with a half-functioning brain can conclude that because no one is checking, thousands of noncitizens are ILLEGALLY registered to vote in November's election

The lawsuit was brought forth by a lady named Ardis Cerny, who was an observer in the 2020 election recount in Wisconsin. She's requesting the court to issue a Writ of Mandamus, forcing WEC and the Department of Transportation to check the existing and future registrants for citizenship.

VANDERBURGH County, Indiana

These are properties obtained by the local government due to property tax delinquencies and other issues. Now the properties are being sold by the government. Historically these properties are purchased by slum landlords, out of town limited liability corporations, and those that have little interest in improving the quality of life for residents.

Why isn’t there a not-for-profit that assists homeowners in paying property taxes until the Indiana legislature creates a viable method to amend the property tax codes?
