[RU / EN] Последнее слово анархиста Евгения Рубашко в суде
До зачитывания окончательного обвинения я по глупости помечал себе нестыковки, моменты для пояснения и контраргументы. После прочтения необходимость в них отпала. И дело даже не в том, что абсурдное и несостоятельное гособвинение, которое вторит видению губопика, было блестяще разбито в ходе прений нашими защитниками в юридическом поле в рамках УК РБ. А в том, что “иногда не до закона”. Дело в “стилизованных А в круге” на наших ноутбуках, гуманистических книгах, которые могут вызвать опасные мысли, в картонных гирляндах и катафотах черно-красного цвета, и даже в пакете с землей цвета черного флага. Дело в мыслепреступлении, в частности, в анархизме.
Мое мировоззрение, то, как я думаю и во что верю, это мое сугубо личное дело. УК РБ распространяется пока еще только на действия. Но давайте вернемся к анархизму.

Начало
Что подразумевает под ним гособвинитель? Свержение государственного строя, разжигание социальной вражды, массовые беспорядки, экстремистскую деструктивную деятельность. Что под ним подразумеваю я? Солидарность и взаимопомощь, личную и коллективную свободу и ответственность, непринятие угнетения в его многочисленных формах.
Как анархист я 10 лет кормил бездомных и нуждающихся людей на улицах Минска, до которых “социальному” государству нет дела, в отличии от военных парадов. Как анархист я участвовал в различных образовательных, социальных и экологических проектах. Как анархист я поспособствовал сохранению сквера Котовка в Сельхозпоселке. Как анархист я не считаю приемлемым убийство и эксплуатацию животных. Как анархист я готов просто помочь человеку, чем смогу.
Это те экстремистские действия, которые я считаю проявлением своих анархистских взглядов. Анархизм — идеалистский, пафосный, радикальный, но созидательный, а не деструктивный.
Никакого экстремистского формирования “Прамень” не существует. “Прамень” это анархистский медиа-ресурс, т.е СМИ, а заявление гособвинителя о том, что данный ресурс пишет только о своих участниках, означало бы, что если “Беларусь Сегодня” пишет про урожай, то все колхозники имеют отношение к редакции газеты.
Судья делала мне замечания за мой смех над кафкианским абсурдом, за мои реплики и даже за ругань (если ее было слышно), когда меня переполняло возмущение. Я виновен в том, что я живой человек с эмоциями, и не умею с ничего не выражающим лицом гособвинителя зачитывать “признательные показания”, о которых заведомо известно, что они написаны в пресс-хате на Окрестина или после пыток и избиений губопиком с собром в здании следственного комитета.
И если нас сегодня судят по УК РБ, то не должно быть также тех, кто равнее других. В качестве напоминания о том, что закон для всех, я хочу привести выдержку из протокола решения трибунала над нацистскими судьями.
"Подсудимые и их коллеги искажали, переворачивали и в конце концов достигли полного уничтожения правосудия и закона в Германии. Они сделали судебную систему составной частью диктатуры. Они убрали всякое сходство судебной независимости. Они угрожали тем, кто попадал в суд, запугивали их, лишали фундаментальных прав. “Судебные процессы”, которые проводились ими, были ужасными фарсами с рудиментарными остатками правовой процедуры, которые были лишь издевательством над несчастными жертвами”.
Мы сами определяем свои жизни собственными личными и коллективными выборами. Кто-то выбирает вписать свои имена в историю политических репрессий. И если кому-то причастному к ним будет икаться, то знайте, что ваши имена вспоминают сидящие политзаключенные, а с ними и их родные и близкие, а с ними и вся страна.
И последнее слово не будет сказано до тех пор, пока все не будут свободны!

Before the final accusation, I wrote down inconsistencies, points for clarification and counterarguments during the trial. After the final accusation, the need for them disappeared. And it’s not even that the absurd and untenable state prosecution – which echoes the vision of GUBOPiK – would be brilliantly defeated during the debate by our defenders in the legal field within the framework of the Criminal Code of the Republic of Belarus. But the thing is, “some cases are not for the law to decide”. This case is about the “stylized “A”s in a circle on our laptops, humanistic books that can evoke dangerous thoughts, cardboard garlands and reflectors in black and red, and even a red and black bag of earth. It is a matter of thought-crime, in particular, of anarchism.

Beginning
What does the public prosecutor mean by it? The overthrow of the state system, inciting social hatred, riots, extremist destructive activity. What do I mean by it? Solidarity and mutual aid, personal and collective freedom and responsibility, rejection of oppression in its many forms.
As an anarchist, for 10 years I’ve been cooking for the homeless and poor people on the streets of Minsk, which the “welfare state” does not care about, unlike military parades. As an anarchist I have been involved in various educational, social and environmental projects. As an anarchist, I contributed to the preservation of the Kotovka Square in Selkhozposelok. As an anarchist, I do not consider it acceptable to kill and exploit animals. As an anarchist, I am ready to simply help a person in any way I can.
These are the extremist actions that I consider manifestations of my anarchist views. My anarchism is idealistic, pompous, radical, but creative, not destructive.
There is no extremist formation “Pramen”! “Pramen” is an anarchist media resource, that is, the media, and the statement of the state prosecutor that this resource writes only about its participants would mean that if Belarus Today writes about the harvest, then all collective farmers are related to the editorial office of the newspaper.
The judge reprimanded me for my laughter at the Kafkaesque absurdity of the trial, for my remarks, and even for swearing (if it was audible) when I was overwhelmed with indignation. I’m guilty of being a living person with emotions, and I don’t know how to read out “confessions” with the expressionless face of the state prosecutor, when it is known that they were written in the torture cell or after torture and beatings by GUBOPiK in the Investigative Committee.
And if today we are being judged according to the Criminal Code of the Republic of Belarus, then there should not be those who are more equal than others. As a reminder that the law is for everyone, I would like to quote from the protocol of the decision of the tribunal over the Nazi judges.
“The defendants and their colleagues distorted, reversed, and in the end achieved the complete destruction of justice and law in Germany. They made the judiciary an integral part of the dictatorship. They removed any semblance of judicial independence. They threatened those who got into the courts, intimidated them, deprived them of their fundamental rights. The “trials” they carried out were horrible farces, with rudimentary remnants of legal procedure that were nothing but a mockery of the unfortunate victims!”
We determine our lives by our own personal and collective choices. Someone chooses to inscribe their names in the history of political repression. And if someone involved in them gets hiccups, then know that your names are remembered by political prisoners who are in prison, and with them their relatives and friends, and with them the whole country.
And my final word will not be spoken until all are free!

Несколько лет он работал в благотворительном проекте КалиЛаска, где помогал нуждающимся получать те необходимые вещи, которые передавали добровольцы. For several years he worked in a charity project called KaliLaska, which helped the people in need to receive things and clothes donated by volunteers. Sasha delivered the collected aid to low-income families, to parentless children, and to sick people and people with disabilities in different regions of Belarus.
Also, for several years, Sasha cooked and distributed food for the homeless in the Food Not Bombs initiative in Minsk. He is always polite, tactful and knows how to easily find a common language with people.
Sasha had the opportunity to go to another country, but he stayed in Belarus, knowing that sooner or later the police will come for him. He is a brave, persistent and principled person. Sasha is a very responsible and caring person, always ready to help and provide support. You can always rely on him. Even now while imprisoned, Sasha knows how to cheer up his comrades in any situation with jokes.

До 2020г он год жил и работал в Амстердаме, но с началом протестов после фальсификации выборов президента - вернулся в Беларусь, т.к. не мог оставаться в стороне от происходящего.
Женя около 10 лет участвовал в инициативе «Food not Bombs» в Минске, всегда поддерживал новых активистов и бездомных, которые приходили на раздачу еды.
Также Женя участвовал в разных социальных, образовательных и экологических инициативах.

[RU / EN] Evgeny Rubashko is an anarchist and a programmer by profession. Zhenya knows rare programming languages and is a professional like no other. Until 2020, he had been living and working in Amsterdam for a year, but when the protests started after the falsification of the presidential election, he returned to Belarus, because he could not remain on the sidelines.
Zhenya has been involved in the Food Not Bombs initiative in Minsk for about 10 years, always supporting new activists and the homeless who came to the food distribution.
Zhenya also participated in various social, educational and environmental initiatives. Because of his desire to help people in need, he became increasingly aware of the social problems of society and the role of the state in their creation. The inner sense of justice and the desire for freedom eventually led Zhenya to anarchism.

[RU / EN] Артем Соловей - анархист, по профессии - инженер-электромеханик. Артем учился в магистратуре и параллельно преподавал в БНТУ, помогал студентам в лаборатории. Артём очень приветливый, отзывчивый и добрый человек, всегда поможет, внимательно выслушает и при необходимости даст совет.
Несколько лет он участвовал в инициативе "Еда вместо бомб" - готовил и раздавал еду бездомным, приносил медикаменты и средства индивидуальной защиты во время пандемии, всеми доступными способами поддерживал нуждающихся. For several years, he participated in the Food Not Bombs initiative - he prepared and distributed food to the homeless, brought medicines and personal protective equipment during the pandemic, and supported those in need in every possible way. He is well-organised, hardworking and sometimes even too attentive to details. Artem can easily support a conversation on any topic. He prefers bicycle as transportation because it is eco-friendly.
Artem's only fault is that he wanted to live in a free country, he helped others and remained true to himself, his ideas and good deeds. For this he was sentenced to 5 years in prison. Support Artem!

[RU / EN] Анархисты, осужденные по делу "Промня", год в заключении
Ментовские облавы на анархистов прошли в Минске 29 июля и 4 августа прошлого года. С тех пор трое наших товарищей - Александр Белов, Евгений Рубашко и Артём Соловей - находятся в заключении.
Рано утром 29 июля Саша Белов был задержан сотрудниками ГУБОП на выходе из дома: у него отобрали ключи от квартиры, нанесли несколько ударов и затолкали в машину. Обыск в квартире проходил без участия Саши. Потом его отвезли в ГУБОП, где избивали, в том числе дубинкой, требовали доступ к телефонам и дать показания на других людей. Но Саша молчал.
К Жене Рубашко пришли утром в тот же день. Он проснулся от слов "поднимаемся", менты уже были в его квартире. Ему застегнули за спиной наручники, когда он еще лежал на диване. После в течение часа у Жени выбивали пароль от телефона: положили на пол, притянули ноги к рукам, в районе щиколотки тоже стянули наручниками; один мент надавливал на спину в районе грудной клетки коленом, другой продолжал наносить удары по разным частям тела руками в перчатках.
"Я понемногу начал отключаться. Они это заметили, перевернули меня на спину. Один открыл мне рот, вставил какой-то предмет наподобие карандаша и сжал нос, а второй начал заливать мне в горло жидкость, предположительно водку. В какой-то момент я стал задыхаться и глотать воздух вместе с водкой. Снова перевернули на живот. Становились ногой на спину, наносили сильные быстрые удары в наружную сторону левого бедра, в одно и тоже место. После ударов 10-15 я сказал, что сообщу пароль", - так описывал пытки сам Женя.
За то, что он не предоставил пароль быстро, один из ментов накинул ему на голову пакет и стал душить. Когда Женя сказал, что уже согласился дать пароль от телефон, его перестали пытать.
Потом в квартире провели обыск, и после Женю увезли в Следственный комитет. Там избиение продолжалось: наносили удары по корпусу, по ногам, в пах, но больше - оскорбляли и угрожали.
Артёма Соловья задержали днем 4 августа. Он вышел с друзьями в магазин, но домой в тот день так и не вернулся. К нему также применяли силу и угрозы, а после допроса осудили на 15 суток административного ареста. После них на свободу Артём не вышел: ему предъявили обвинения и перевели в СИЗО.

Спустя восемь месяцев - 29 марта - начался суд над Сашей, Женей и Артемом, который в первый же день сделали закрытым. Приговор вынесли через месяц - 22 апреля: суд постановил, что вина парней доказана, и назначил каждому из них по 5 лет колонии.
Теперь, после рассмотрения апелляционной жалобы, которую суд ожидаемо не удовлетворил, ребят развезли по колониям, где они будут отбывать срок.

Ментовские облавы на анархистов прошли в Минске 29 июля и 4 августа прошлого года. С тех пор трое наших товарищей - Александр Белов, Евгений Рубашко и Артём Соловей - находятся в заключении.
Рано утром 29 июля Саша Белов был задержан сотрудниками ГУБОП на выходе из дома: у него отобрали ключи от квартиры, нанесли несколько ударов и затолкали в машину. Обыск в квартире проходил без участия Саши. Потом его отвезли в ГУБОП, где избивали, в том числе дубинкой, требовали доступ к телефонам и дать показания на других людей. Но Саша молчал.
К Жене Рубашко пришли утром в тот же день. Он проснулся от слов "поднимаемся", менты уже были в его квартире. Ему застегнули за спиной наручники, когда он еще лежал на диване. После в течение часа у Жени выбивали пароль от телефона: положили на пол, притянули ноги к рукам, в районе щиколотки тоже стянули наручниками; один мент надавливал на спину в районе грудной клетки коленом, другой продолжал наносить удары по разным частям тела руками в перчатках.
"Я понемногу начал отключаться. Они это заметили, перевернули меня на спину. Один открыл мне рот, вставил какой-то предмет наподобие карандаша и сжал нос, а второй начал заливать мне в горло жидкость, предположительно водку. В какой-то момент я стал задыхаться и глотать воздух вместе с водкой. Снова перевернули на живот. Становились ногой на спину, наносили сильные быстрые удары в наружную сторону левого бедра, в одно и тоже место. После ударов 10-15 я сказал, что сообщу пароль", - так описывал пытки сам Женя.
За то, что он не предоставил пароль быстро, один из ментов накинул ему на голову пакет и стал душить. Когда Женя сказал, что уже согласился дать пароль от телефон, его перестали пытать.
Потом в квартире провели обыск, и после Женю увезли в Следственный комитет. Там избиение продолжалось: наносили удары по корпусу, по ногам, в пах, но больше - оскорбляли и угрожали.
Артёма Соловья задержали днем 4 августа. Он вышел с друзьями в магазин, но домой в тот день так и не вернулся. К нему также применяли силу и угрозы, а после допроса осудили на 15 суток административного ареста. После них на свободу Артём не вышел: ему предъявили обвинения и перевели в СИЗО.

The police raids on the anarchists took place in Minsk on July 29 and August 4 last year. Since then, three of our comrades - Alexander Belov, Evgeny Rubashko and Artem Solovey - have been in prison.
In the early morning of July 29, Sasha Belov was detained by GUBOP officers as he was leaving his home: they took his keys, hit him several times and pushed him into a car. The search of the apartment took place without Sasha's participation. Then the cops took Sasha to GUBOP, where they beat him, including with a truncheon, and demanded access to his phone and to testify against other people. But Sasha kept quiet.
Cops came to see Zhenya Rubashko in the morning of the same day. He woke up to the “wake up” command, and the cops were already in his apartment. They handcuffed him behind his back while he was still lying on the sofa. After that, they tried to beat out Zhenya's phone password for an hour: they put him on the floor, pulled his legs to his hands, also handcuffed him around the ankle; one policeman pressed on his back near his chest with his knee, another kept hitting him on different parts of his body with his gloved hands.
"Little by little I started to pass out. They noticed that, turned me over on my back. One of them opened my mouth, inserted some object like a pencil and squeezed my nose, while the other started pouring liquid, presumably vodka, down my throat. At some point I began to choke and swallowed air along with the vodka. They turned me over on my stomach again. They put a foot on my back and hit me hard and fast on the outside of my left thigh, in the same place. After 10-15 strokes, I told him I was going to give him the password," this is how Zhenya described the torture.
For not giving the password quickly, one of the cops put a bag over his head and began strangling him. When Zhenya said he had already agreed to give the password to his phone, they stopped torturing him.
Then the apartment was searched, and Zhenya was taken to the Investigative Committee. There the beating continued, hitting in the body, legs, and groin, but most of all, insulting and threatening.
Artem Solovey was detained on the afternoon of August 4. He went out with friends to the store, but did not return home that day. Cops also used force and threats on him, and after an interrogation he was sentenced to 15 days of administrative imprisonment. Artem was not released after that: he was charged and transferred to a pre-trial detention center.
At first, the guys were accused of participating in mass protests in August and October 2020, and a few months later they were also accused of participating in the allegedly extremist formation "Pramen" (a media resource on the Internet and social media) only because their actions of solidarity with them were published in a telegraph channel.
The trial of Sasha, Zhenya and Artem started eight months later, on March 29, and was closed from the public on the first day. The verdict was handed down after a month - on April 22: the court decided that the guilt of the guys had been proved and sentenced each of them to 5 years in prison.
Now, after an appeal, which the court predictably upheld, our comrades have been sent to penal colonies where they will serve their time.

Анархист Артём Соловей в одном из своих писем на волю написал, что он практически не знает никаких новостей, а письма доходят очень плохо. Он делится своими размышлениями о восприятии реальности и однообразии дней в тюрьме:
"Волнуюсь за всех. Особенно с началом этой долбанной войны. <...>
Если подумать, то всё, что на воле, осталось для меня в том самом состоянии, как летом 2021 года. Всё - это отношения с людьми, знания о внешнем мире и тому подобное, что я не в состоянии описать словами. Хоть новая информация приходит, но воспринимается как-то иначе. Кто-то здесь сказал такую фразу: "Время для тебя останавливается в том году, в котором тебя закрыли". Ну да хватит об этом. <...>
У меня дни довольно однообразны, хоть и проходят мигом. Но меня это не напрягает совсем, потому что главное это найти занятие и пока у меня выходит. <...>
Когда увидимся, про то, как я провёл (и проведу ещё) это время я сильно рассказывать не буду. Не то чтобы это что-то страшное, о чём хочется забыть. Нет! Просто ничего тут интересного нет, кроме интересных людей. Так что готовься говорить ты ;) <...>
Отсутствие связи и возможности общения рождает мелкие бесячие мысли-сомнения. Сомнения в том, что кому-то вообще интересно, что я пишу и что тут со мной. Проскакивают иногда эти мысли мельком. Мне до них нет дела, и меня они не трогают. По крайней мере пока.
Я в вас всех там верю. А ваши приветы эту веру укрепляют. Пока я ни в чём не разочаровался, а кое-где даже приятно удивился, надеюсь, что всё хорошо будет и дальше.
А если даже я не прав, то в общем-то мне всё равно.

Everything - relationships with people, knowledge about the outside world and the rest, which I am not able to put into words. Although new information comes, it is perceived somehow differently. My days are pretty monotonous, although they pass in a flash. But it doesn’t bother me at all, because the main thing is to find something to do and so far I’m doing well with that. <...>
When we see each other, I won’t talk much about how I spent (and will spend) this time. Not that it's something terrible that you want to forget about. No! There is simply nothing interesting here, except for interesting people. So get ready to do all the talking ;) <...>
The lack of communication or the possibility of communication gives rise to petty irritating thoughts-doubts. Doubts that anyone is even interested in what I write and what is happening with me. Sometimes these thoughts slip through. I don't care about them, and they don't touch me. At least for now.
I believe in all of you there. And your greetings strengthen this faith. So far I was not disappointed in anything, and in sometimes I was even pleasantly surprised, I hope that everything will be fine in the future.
