4) The opening of an investigation by Judiciary itself violates the accusatory system adopted by the Brazilian Constitution. - Art. 129, I "exclusive responsibility of the Public Prosecutor's Office to promote public criminal action".
5) The investigation violates freedom of speech
Freedom of speech is not an absolute right in Brazil. But STF is treating "criticisms against the judges" as if they were "fake news" and "crimes against the democratic rule of law".
