The Insurrection Act is a U.S. federal law that empowers the President to deploy active-duty military forces and federalized National Guard troops domestically for law enforcement purposes under specific circumstances, such as suppressing insurrections, rebellions, or domestic violence.
It serves as a key exception to the Posse Comitatus Act of 1878, which generally prohibits the use of federal military personnel for civilian law enforcement within the United States.
The law is codified in Title 10 of the U.S. Code, Sections 331–335 (previously Sections 251–255 before renumbering), and its text is relatively brief but broad, leaving significant discretion to the President. The Act consists of several sections outlining when and how the President can invoke it:Section 331 (Federal Aid for State Governments): The President may deploy troops upon the request of a state's legislature (or governor, if the legislature cannot convene) to suppress an insurrection against the state government. This requires state consent and is the most commonly used provision historically.
Section 332 (Use of Militia and Armed Forces to Enforce Federal Authority): The President can use troops to enforce federal laws or suppress rebellion when "unlawful obstructions, combinations, or assemblages, or rebellion against the authority of the United States" make it "impracticable" to enforce laws through normal judicial processes. This can be done without state consent.
Section 333 (Interference with State and Federal Law): This has two parts. First, the President can act to suppress "any insurrection, domestic violence, unlawful combination, or conspiracy" that hinders state or federal laws to the extent that people are deprived of constitutional rights, and state authorities are unable, unwilling, or fail to protect those rights (considered a denial of equal protection under the Constitution). Second, it allows suppression of actions that "oppose or obstruct" federal laws or impede justice. Like Section 332, this can override state objections and is notably broad.
Section 334 (Proclamation to Disperse): Before deploying troops, the President must issue a proclamation ordering insurgents or obstructors to disperse peacefully within a limited time.
Section 335: Defines "State" to include Guam and the Virgin Islands for the purposes of the Act.
The Act does not authorize martial law, which would involve the military fully replacing civilian government; instead, troops assist civilian authorities.
Deployed forces remain subject to other laws and cannot violate constitutional rights. NOTE: Some of us, like myself served over 17+ years with the Army National Guard - Enlisted to Officer through OCS w/ 14 of those years being Active Duty ... NOT to mention the Combat Deployments as a USACAPOC Governance Chief in both Iraq & Afghanistan @ the HIGHEST LEVEL in the C.O.E. The seas will turn to blood and everything in it will die. The nations will be distressed and confused. The people will faint with fear. They will crawl into caves, begging the stones to cover them, to hide them from the Son of Man. But there will be no escape. It is time for God to judge the world for seeking authority in themselves, their own creations, and demons, instead of submitting to their Creator. At this time, the "powers of the heavens will be shaken." Satan, the "god of this world" (2 Corinthians 4:4) will find his power slipping. He will hold tight to the Antichrist but fall powerless when Jesus returns "in a cloud with power and great glory" (Luke 21:27). The disciples still think Jesus is going to expel the Romans and restore Israel to independence. They didn’t realize that within days Jesus will hang on the cross. Even after His resurrection, they anticipate His kingdom (Acts 1:6). Jesus is telling them His followers must first face a lot of hardship, persecution, and horror. But their redemption will come (Luke 21:28). “This is NOT the RV - Redemption Folks! This records the last section of Jesus' prophecy about the challenges the Jews & His followers will face. After war, natural disasters, persecution, the destruction of the temple and Jerusalem, and the times of the Gentiles, the Son of Man will appear and judge the world. It is at this moment that Jesus-followers can be confident that Jesus' time has come. In anticipation, Jesus admonishes His followers to stay sober and alert, to make the most of the time before He returns (Luke 21:29–36). This warning is also in Matthew 24:29–31 and Mark 13:24–27 but it originates in Daniel 7:13–14.
