Public Hearing Thursday on Court Nominee
Can We Keep Dan Will from the Superior Court Bench? 

The hearing for Gov. Chris Sununu's problematic N.H. Superior Court nominee Dan Will is coming up this Thursday, and we need to remind the Executive Council not to support this nominee before they meet.

Here is the history: N.H. Solicitor General Daniel Will wrote the Binford Objection, which led to the N.H. Superior Court decision stating that the governor has the authority to "suspend the constitution" during a State of Emergency. Dan Will has been nominated to sit on this same court, making the court an even bigger constitutional threat.

Clearly, we must prevent Dan Will from taking residence on the N.H. Superior Court bench for 20 years. Please call and email all five of the executive councilors and tell them we need our judges defending the constitution, not undermining it. Ask them to say "no" to Dan Will's nomination and urge the governor to find nominees that respect our rights.

Update: Bill to Ban Vaccine Passport
The House Executive Departments and Administration Committee is still working on an amendment to SB 155 that would ban a vaccine passport, and its prospects are looking promising. Behind the scenes, our people are working on language that would strengthen religious and medical exemptions for employees to decline a vaccination they don't want.

It's important to note that your efforts helped Senators amend SB 155 into language that we can support. So thank you for that! We wanted to let you know that we support the underlying legislation as a result. Also, most of our people on the House committee and in the House are supporting this effort, but there are a few holdouts who think that government shouldn't get involved with preventing this gross violation of individual liberty. Here's some thoughts to share with them that may change their mind.

Would you please email the N.H. House Executive Departments and Administration committee and ask them to support adding an amendment to SB 155 that bans vaccine passports. Also, please email committee member John Sytek, a holdout representative from Salem, or call him at 603-893-8889, and explain to him how important this amendment is to protecting our way of life.

◦ The underlying bill, HB 187, would add checks on the commissioner of the Department of Health and Human Services to prevent him from unilaterally implementing emergency regulations without legislative oversight or approval. The Senate amendment would add licensing requirements for social workers. Please ask the Senate to support the bill, but not the amendment.

HB 417 is the bipartisan bill that passed the House with a veto-proof majority to amend the State of Emergency statutes and prohibit the governor from spending federal funds on his own. We support the bill in part. Ideally, the language in the budget (HB 2) from sections 76 and 77 as well as the language in HB 417 in section 3, subparagraph V, and section 4 should be passed into law. It may also make sense to add section 3, subparagraph V, and section 4 of HB 417 into the budget to go along with sections 76 and 77, as well as section 332, which includes language from HB 63. We would still like you to email the full Senate and ask them to support the three emergency reforms in the budget, even if you've done so already.

Activists aligned with ReopenNH have been scouring existing statute to address the issue of forced masking children in schools. Yesterday, they uncovered Title X, Section 126-U:4:

"No school or facility shall use or threaten to use any of the following restraint and behavior control techniques:
I. Any physical restraint or containment technique that:
(a) Obstructs a child's respiratory airway or impairs the child's breathing or respiratory capacity or restricts the movement required for normal breathing;
...(d) Involves pushing on or into the child's mouth, nose, eyes, or any part of the face or involves covering the face or body with anything, including soft objects such as pillows, blankets, or washcloths; or
...IV. Any technique that unnecessarily subjects the child to ridicule, humiliation, or emotional trauma."

Today this was presented to Commissioner Frank Edelblut, who we are told will be calling the Attorney General, asking the AG to send out notice to schools.

Update on Daniel Will hearing:

Establishment politicians, CEOs, and others came out to testify in favor of Daniel Will for Superior Court judge. It was the who's who of well-connected elites – 14 testifying in his favor that he's a nice fella. Three testified for the People, including both ReopenNH Chairman Andrew Manuse and ReopenNH Treasurer JR Hoell, bringing up concerns for civil and religious liberties.

The vote on Will's nomination will likely be in 2 weeks. We will keep you updated. We will likely need a strong showing emailing the Executive Councilors in that time period.

Here are talking points to help you compose your message:
1. Human rights ought to be protected in all parts of society, public and private, from all bad actors, and the right to bodily autonomy is a recognized human right.
2. According to the Declaration of Independence, governments are instituted to secure the rights of the minority to life, liberty and the pursuit of happiness. Sometimes, the government must step in to prevent powerful private actors from infringing the rights of the minority that don't have the resources to defend their rights.
3. As a society, we have long determined that private businesses don't have a right to discriminate, and that includes discrimination against those who refuse a particular medical intervention.
4. A vaccine passport is not the same as a "no shirt, no shoes, no service" policy, because wearing shoes does not pose a medical risk. Vaccines do pose a medical risk and courts have long upheld that we cannot force medical risk on anyone, even criminals.
5. We cannot create a tiered society where those who cannot or will not receive a vaccine are barred from participating. We've been down that road before with other modes of discrimination, and we do not want such a regressive idea to take hold. This is a battle we cannot afford to lose.
6. Vaccine passports are a dangerous invasion of personal and medical privacy. This bill is essentially strengthening HIPAA law.
7. The proposed vaccine passport prohibition does not apply to all private businesses. It only applies to private businesses contracted with the state and state and local government. However, the amendment language presents a firm statement that discrimination will not be tolerated in New Hampshire.
Quick reminder: When you email your elected officials, please make sure to include both your NAME and your TOWN. They look for any reason to disregard messages, and not identifying yourself as a NH resident is one of the reasons they use.
