Nonprofit Creation Process
It takes more time to form legally a nonprofit corporation than it does to form a for-profit corporation. Although the actual incorporation process is short, for a nonprofit, incorporation is just the beginning of the process. After incorporating, you must obtain an employee identification number. You must then submit an application to the IRS requesting official classification as tax-exempt. Without this classification, even though you incorporated as a nonprofit, your nonprofit is not legally considered one

Once the IRS receives the appropriate completed application for exemption, it will take some time to process your request. If the IRS has additional questions or needs additional information, it will contact you with that written request. If the IRS approves your nonprofit request, then you will receive a determination letter stating so typically within three to six months of submission. However, it can take as little as two months and as long as 12 months. The IRS will expedite your application in RARE circumstances.
