Supreme Court returns for oral arguments next week, in the meantime, they’ve released their full term calendar for the rest of the 2022-2023 oral argument sitting. April 26th is the last day of oral arguments for the term.

It’s Tuesday morning at the Supreme Court, and it’s an argument day. Today the Court will hear a case challenging certain aspects of section 230 of the Communications Decency Act of 1996, which includes company immunity.
In a case called 21-1333 GONZALEZ V. GOOGLE LLC, the Court will answer the following question: “Does section 230(c)(l) immunize interactive computer services when they make targeted recommendations of information provided by another information content provider, or only limit the liability of interactive computer services when they engage in traditional editorial functions (such as deciding whether to display or withdraw) with regard to such information?”

Justice Barrett delivered the opinion for a unanimous Court, Justice Sotomayor filed a concurring opinion, which Justice Jackson joined.
Next opinion, in a 6-3 decision, is from the case HELIX ENERGY SOLUTIONS GROUP, INC., ET AL. v. HEWITT. The case involves the issue of overtime pay when working for more than 40 hours a week on a full time job. Justice Kagan delivered the opinion of the Court. Justices Kavanaugh, Gorsuch and Alito dissented in the decision.

Food for thought as we wrap up the second opinion day of the season. Aside from the past two years, the Court has gone back to doing bench readings of their opinions, doing away with the 10 minute increments in between opinions on their websites, if there is more than one. That being said, and knowing that we have no idea which decision will be released on the given day, there will likely be a delay between the time it’s released and the time it’s sent here due to reading the opinion ourselves.
