The story had been that Finicum drew his handgun and pointed it at FBI agents and so they were justified in shooting him. In fact, it later came out even before Finicum had emerged from the vehicle, an FBI sniper had begin firing on him. He drew because he heard a second shot and the bullet missed him.

"Investigators looking into the shooting were able to identify those responsible for six of the eight rounds fired that day. No one owned up to the other two.
