The story had been that Finicum drew his handgun and pointed it at FBI agents and so they were justified in shooting him. In fact, it later came out even before Finicum had emerged from the vehicle, an FBI sniper had begin firing on him. He drew because he heard a second shot and the bullet missed him.

At first, the FBI lied and insisted none of their agents had fired on Finicum until he drew his handgun and pointed it. Only much later did the truth emerge that a FBI sniper had fired several shots at Finicum - all of which missed.

That agent was acquitted by a jury that determined it couldn't conclusively prove who fired the 2 shots. That's what they jury claimed, anyway. "Investigators looking into the shooting were able to identify those responsible for six of the eight rounds fired that day. No one owned up to the other two. After an investigation, Astarita was indicted in June 2017.
Prosecutors said he was the only one who could have fired the shots. Their assertion was based on FBI aerial surveillance videos and forensic analysis tracing a bullet back to his position."
