I hereby formally request a copy of any Regulated Consumer Credit Agreement ("RCCA"), for fixed-sum or running account credit, which lists you and I as parties, pursuant to s.77-79 of the Act.
 
I require you to provide me with the following:
 
• a copy of the RCCA relating to any account youdeem to be mine.
• copies of all other documents and notices mentioned in the RCCA.
• any statement of account.
• together with any other documentation the Actrequires you to provide.
 
If it is your view that you are not the creditor, s.175 of theAct applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. In the case of an absolute assignment, you are a creditor as defined by s.189.
 
If you contend that you purchased the rights but not the duties of any agreement, you are reminded that s.189 of the Act is clear that an assignment is of both rights and duties. Your attention is drawn to ss.5(2), 3(b), 6 and 7 of the Consumer Protection from Unfair Trading Regulations 2008 (CPUTR).
Equally, I hereby request a a copy of any securityinstrument executed in relation to the agreement afterthe making of the agreement, pursuant to s.110 of the Act from the person appearing to be the creditor orowner under a regulated agreement, within theprescribed period (12+2 days) after receiving a requestin writing to that effect from the debtor or hirer.
This means that you should provide a copy of anyinstrument which has facilitated the creation of anysecurity interest in the RCCA to any third party. Failureto comply with the request will render the resultingRCCA, unenforceable.
I expect you to comply fully and properly with both requests, within the statutory time limit (12 + 2 days), otherwise any agreements will become unenforceable.
I have enclosed my payment of 2 x £1 postal orders,which is the statutory fee for each request, please notethat these funds are not to be used for any otherpurpose and look forward to hearing from you.
