Austria obliges YouTube to grant users access to their data

"The Austrian data protection authority announced on Friday that it has compelled YouTube to comply with EU regulations and respond to user requests for access to the data stored about them.

In 2019, the well-known Austrian data protection campaign group Noyb (None of Your Business) filed complaints against eight online streaming services, including YouTube and Netflix, accusing them of "structural violations" of EU data protection laws.

The complaint against YouTube was submitted on behalf of an Austrian user to the country's data protection authority.

The regulatory body confirmed to AFP on Friday that it had issued a ruling "against Google LLC (YouTube)" regarding the lawsuit filed by Noyb.

In its complaints, Noyb stated that the services had violated the landmark EU General Data Protection Regulation (GDPR) by not providing users access to the data or information about the use of that data stored by the companies.

Google, which owns YouTube, now has "four weeks to comply with the decision, but also has the option to appeal," the NGO said in a statement on Friday.

Noyb described the authority's decision as a "victory," but lamented that the country's regulatory body took "five and a half years" to reach it.

"Making an access request should allow (users) to exercise rights such as the right to deletion or correction" of their data, the group said, but due to delays, this has become "impossible."

Google did not immediately respond to an AFP request for comment.

Noyb has initiated several legal actions against US tech giants like Meta, which owns Facebook and Instagram, and Google, often triggering regulatory actions for violations of the GDPR.
