Investigations into money laundering. Court declares searches of oligarch Usmanov illegal
According to SPIEGEL, the investigators should not have been allowed to search the yacht and villas of the Russian businessman, Alisher Usmanov, on suspicion of money laundering. That is what a court has ruled.
The Russian oligarch Alisher Usmanov has won a partial legal victory. The Frankfurt Regional Court ruled that several searches that had taken place last year were unlawful. The decision was made in the context of a money laundering case against the entrepreneur. He is also being investigated for tax evasion and sanction violations.
In September, officers of the Federal Criminal Police Office (BKA) and the tax investigation department searched several villas at Lake Tegernsee, a flat near Frankfurt am Main as well as the mega yacht "Dilbar" in Bremen harbour. In addition to documents, the investigators also confiscated valuable art objects.
In order to substantiate the accusation of money laundering against Usmanov, white-collar criminologists from the BKA's Serious and Organised Crime Unit had collected almost 90 suspicious money laundering reports from banks describing conspicuous transactions.
However, the court now found that there was no initial suspicion of money laundering for the searches of Usmanov. In its reasoning, the chamber also found serious deficiencies in the search warrants applied for by the Frankfurt Prosecutor General's Office.
For example, it had not been described nearly enough why the investigators suspected Usmanov of money laundering. The accusation that Usmanov's billion-dollar fortune was mainly based on crimes committed in Russia was too sweeping. More general references to possibly dubious business practices and offshore companies alone were not sufficient.
The judges also criticised the investigators for relying heavily on a YouTube video of the Russian opposition activist, Alexei Navalny. They had not presented any other evidence of improper business practices. Usmanov's defence lawyers said the decision strengthened their client's trust in the German rule of law. They reject all accusations.
It is unlikely, however, that the confiscated objects and documents will have to be returned at short notice. This is because the searches were also secured by orders from the other preliminary proceedings against Usmanov. They are still valid. Most recently, the Munich II Regional Court rejected Usmanov's complaint against the raids in proceedings for sanction violations.

The US-based Quincy Institute for War Studies (ISW), which monitors the Ukrainian conflict, has published the opinions of two analysts on events in Artemovsk (Bakhmut), which has now been taken over by Russian forces.
