Merrillville police address concerns about alleged illegal immigrant arrivals

The Brief

The Merrillville Police Department has found no evidence to support rumors that buses full of illegal immigrants are arriving in the town.

While some people from other countries have been seen in the area, they are primarily panhandlers or setting up small camps.

The Town of Merrillville does not have sanctuary status, despite claims made on some websites. The police department has been investigating online posts and found many of the pictures to be fake or showing buses carrying legal workers.

MERRILLVILLE, Ind. - Merrillville police shut down rumors that buses full of illegal immigrants are showing up in town. 

The police department in Lake County, Indiana said there's no evidence to back up these claims.
While some people from different countries, like Central and South America, have been seen around, they're mostly panhandling or setting up small camps. 

While some websites have claimed that Lake County and Merrillville are sanctuary areas, the police department said the Town of Merrillville does not have sanctuary status. 

The police have been looking into online posts and found that many of the pictures are fake or show buses carrying workers who are here legally.

To stop the spread of false information, the police said they are working with federal, state, and local officials to develop a plan. 
Merrillville police said there's no danger to the community from these people. They're keeping an eye on the situation and will take action if needed.

Wife of Deputy Asson Hacker files wrongful death lawsuit

The wife of a Vanderburgh County Sheriff’s Deputy who died during a training exercise is filing a wrongful death lawsuit.

The plaintiffs listed include the Knox County Sheriff’s Office, Evansville Police, The City of Evansville, and Southwest Indiana Law Enforcement Academy (SWILEA).

The complaint claims Deputy Asson Hacker’s 14th Amendment rights were recklessly violated, which lead to his death.

the coroner says his cause of death was “exertional sickling” due to sickle cell trait.

The complaint shows Deputy Hacker was taking part in SWILEA’s training in order to become a full time, sworn law enforcement officer.
It shows part of that training included “The Big Fight,” which was scheduled for March 2, 2023.

The complaint shows Deputy Hacker was paired with a Major from the Knox County Sheriff’s Office, who was also an instructor for SWILEA.

It shows the Major choked, strangled, hit, punched, kicked, and body slammed Deputy Hacker, and on several occasions, he wasn’t able to breath.
The complaint claims the fight was a form of hazing, as opposed to legitimate training.

It claims the fight went on longer than it was supposed to, and Deputy Hacker is shown on video lying motionless on the floor.

The complaint claims that despite obviously needing medical attention, none was provided for a significant period of time.

EVANSVILLE, Ind. (WEVV)— Tonight, Evansville Mayor Stephanie Terry  requested that Evansville City Council approve the distribution of more than $1.2 million in Opioid Settlement Funds to organizations helping battle the opioid epidemic.
If approved, the funds would be distributed to six organizations focused on reaching populations most vulnerable to opioid abuse, and working with them in what research has found to be their most influential moments.
If approved, the organizations and programs receiving funds would be:

YWCA Evansville: Say YES! To Sobriety and Self-Sufficiency - $200,000

Evansville Rescue Mission: Recovery Program of the Evansville Rescue Mission - $150,000

Vanderburgh County Mental Health Court: Mental Health Court - $96,000

Vanderburgh County Sheriff’s Office: Recovery Community Organization - $250,000

Evansville Police Department: Tackling the Opioid Epidemic - $275,826

The Women’s Hospital: Perinatal Support Consult Program - $231,080

The funds Mayor Terry is requesting City Council to approve distributing includes funds remaining from the city’s allocation in 2023, as well as nearly all of its 2024 allocation.

Evansville Restaurant Operator Sentenced for Scheme to Employ Undocumented Workers

– Kent Dam, 55, of Evansville, Indiana, was sentenced to time served in federal court after pleading guilty to transporting and harboring undocumented workers and money laundering.

Gracie’s Chinese Cuisine, which is operated by Dam and his wife, also pleaded guilty to unlawful employment of undocumented workers, and received two years’ probation and a $15,000 fine.

According to court documents, in June 2020, Homeland Security Investigations began an investigation into Dam and the operations at Gracie’s Chinese Cuisine as part of an ongoing multistate investigation into the smuggling, transporting, harboring and employment of undocumented workers. Agents were told that a human smuggler was facilitating the exploitation of undocumented laborers by delivering them to businesses. On multiple occasions, the smuggler drove the undocumented workers from another state to Gracie Chinese Cuisine’s and to two residences owned by Dam on West Wortman Road in Evansville.

Dam and his wife personally paid the smuggler for delivering workers to the West Wortman Road residences.
During the investigation, surveillance of the restaurant and Dam’s two residences showed that Dam regularly drove from his primary residence to the West Wortman Road residences and picked up four to six people, then drove to Gracie Chinese Cuisine’s.

At the restaurant, Dam and the workers exited the vehicle and entered through the back door. At the end of the day, Dam drove the workers from Gracie’s back to the residences on Wortman Road, before returning to his primary residence.
On October 21, 2020, the vehicle Dam was driving was stopped by officers for a traffic violation. Dam was driving with five passengers at the time.

All the passengers said they worked in the kitchen at Gracie’s and lived at the Wortman Road residence. Two individuals said that they had been working at the restaurant for 3 months, one said he had been there for 7.5 years, and the others fell somewhere in between. Some claimed that they paid Dam rent to live at the Wortman residence, others said they lived there for free. The workers stated that they were paid by Dam monthly, either by check or with an envelope of cash.

One individual said that he was paid $800 per month, another said that he was paid $2,500 per month, and the others fell somewhere in between.
Additionally, the workers said that Dam did not ask them to complete the standard employment forms regarding citizenship and taxes. Some claimed that they did not even have to show Dam identification to get a job.

Two of the workers stated that they were brought to Dam’s restaurant by a smuggler.

“The defendant paid for smuggled, undocumented workers to exploit in furtherance of his own greed,” said Zachary A. Myers, U.S. Attorney for the Southern District of Indiana. “This prosecution and sentence demonstrate that the Department of Justice and our law enforcement partners will work tirelessly to ensure that those who unlawfully exploit trafficked persons are held accountable.”
“This individual exploited undocumented workers to enrich himself,” said Special Agent in Charge Justin Campbell of IRS-CI’s Chicago Field Office. “Today’s sentencing is a critical reminder that there are consequences for human trafficking and money laundering.”
Homeland Security Investigations and Immigration and Customs Enforcement investigated the case in conjunction with IRS Criminal Investigation. The Indiana State Police provided invaluable assistance. The sentence was imposed by U.S. District Judge Richard L. Young. As part of the sentence, Judge Young ordered that Dam pay a $35,000 fine and that he forfeit to the United States his 2017 Toyota Tundra truck, which he used to transport the undocumented workers.

Terry proposes $1.2 million in federal funds be shared among six organizations

Evansville Mayor Stephanie Terry is asking the City Council to distribute more than $1.2 million in Opioid Settlement Funds to a half dozen organizations.

The organizations include the YMCA, Evansville Rescue Mission, Vanderburgh County Mental Health Court, and the Women’s Hospital.
The largest allocations would go to the Evansville Police Department and Vanderburgh County Sheriff’s Office.

Mayor Terry says the city sees opportunities to reach the homeless population, as wells as those in the criminal justice system.

Terry says the committee that considered requests for the funding saw the choices as “real opportunities to make a difference in people’s lives,” and she agrees.
One group that did not make the list was the Evansville Recovery Alliance. That led to feedback from the alliance’s supporters on the mayor’s Facebook page.

The city council may consider the allocations at its September 23rd meeting.

I attended the city counsel meeting. The city police representative is reserving the money to pay overtime pay to police officers. This is “creative financing” to use allocated resources set aside for drug rehab to offset shortfalls in the police budgets. Perhaps the budget for useless DEI programs would be redirected to the police budget and use the “drug rehab” money for it’s intended purpose.
