Brazilian court determines the blocking of Telegram in the country (despite Telegram forward the group creator data)

The court ordered Telegram to send the phone (and IP) data of all members of 2 neo-Nazi groups in less than 24 hours.

About the 1º group, Telegram release the IP and phone of the creator of the neonazi channel @antissemitabr:

About the 2º group "卐 Frente Anti-Semita 卐" (group ID: 1586278133) Telegram did not send any data claiming that the group had already been deleted and that it would only be able to send the creator's data if the police informed data that identified the creator's account (such as his ID or his phone number).

Despite this, the judge in the case determined the blocking of Telegram in the country. According to him, Telegram failed to comply with the decision because he had requested that Telegram send data from all members of the group (not just from administrators).

The judge also determined, as long as Telegram did not send the data, the application of a daily fine in the amount of 1,000,000 BRL per day or 5% of Telegram's profit in Brazil in 2022 (whichever was less).
Considering that Telegram does not have a very high invoice in Brazil, the amount of the fine is negligible.

Brazilian court determines the unblocking of Telegram in the country 🇧🇷🕊

This week a brazilian judge blocked the app in the whole country.

Telegram claimed judicially that:
🔹 comply with judge's decision would be technically impossible as the groups have already been deleted;
🔹 the judge order itself was incomplete since links to the groups or any information from those investigated were not initially included;
🔹 the brazilian law (Marco Civil da Internet) does not allow the complete blocking of a service, but only of certain kinds of its activities;
🔹 the police leaked to the press information about the secret lawsuit before the "citation" of Telegram itself;
🔹 it would be possible for the police (in possession of the seized cell phone) to create a backup the conversations allowing Telegram to help identifying the users. But the police didn't do it;
🔹 penalties imposed by the judge were "disproportionate and unreasonable", against Brazilian Constitution and were trying, in fact, to prevent the operation of Telegram in Brazil.

The court, according to the understanding signed by the current Brazilian Supreme Court votes in ADPF 403 and ADI 5527 (lawsuits about the blocking of Whatsapp in Brazil that happend 2015 and 2016), understood that the measure of complete suspension of the service is not reasonable, considering that it would also affect the freedom of communication of thousands of people.

The court maintained the fine penalty and urgently ordered the notification of the companies Vivo, Claro, Tim, Oi, Google and Apple to cease any kind of blocking of Telegram in the country.

STF Minister Alexandre de Moraes determines the suspension of Telegram in Brazil for 72 hours

According to the minister, Telegram would be using "illicit disinformation" to induce the population to "force" parliamentarians against PL 2630/20. He refer to this message.

The minister determined that Telegram:
1) Delete all messages sent to users within 1h.
2) Send the message below to all users:
“By determination of the FEDERAL SUPREME COURT, the company Telegram communicates: The previous message from Telegram characterized FLAGRANT and ILLEGAL DISINFORMATION that attacks the National Congress, the Judiciary, the Rule of Law and the Brazilian Democracy, since, fraudulently, it distorted the discussion and the debates on the regulation of providers of social networks and private messaging services (PL 2630), in an attempt to induce and instigate users to coerce parliamentarians”.

In case of non-compliance with the decision within a maximum of 1 hour:
3) Temporary suspension of Telegram in Brazil for 72 hours.
"Natural and legal persons who incur conducts in the sense of using technological subterfuges for the continuity of communications made by the TELEGRAM, in the event of suspension, will be subject to civil and criminal sanctions, as provided by law, in addition to hourly fine of BRL 100,000.00 (one hundred thousand reais)."
It is unknown whether this refers to users using proxy or VPN. If so, the minister would be itself offending article 5, XLV, of Federal Constitution: "no penalty will pass from the person of the condemned person..." (principle of intranscendence of punishment).
4) Fine of BRL 500,000 per hour to Telegram.

The Minister also determined that:
5) The Federal Police must interrogate legal representatives of Telegram in Brazil within 48 hours about:
- Who authorized the sending of the message.
- The reasons for sending the message.

It is not yet known whether the Minister acted (again) "ex officio" (without any request from any party or Public Ministry).
