UIA Flight PS756, en route from Tehran to Kiev, was shot down by two Iranian anti-air missiles on January 8th, 2020, during a time of increased tensions following the illegal assassination of Lieutenant General Qassem Soleimani by the United States.
Most of the passengers were bound for Canada, including 55 Canadian citizens and 30 permanent residents. Tragically, all 176 people on board were instantly killed, after Iran mistakingly identified the aircraft as a hostile military target.
The ruling in Canada came as a result of determining that Ukraine International Airlines had acted 'in a negligent manner', because it failed to properly identify the risk that Iranian airspace posed at the time, even though airspace was technically open.
The lawyers of the victims' families called it a 'landmark ruling'. 'At a time of heightened conflicts around the world, the judgment sends a clear message to international airlines that open airspace cannot be assumed to be safe airspace', they said.
